A federal jury awarded $9 billion to an Actos patient who developed bladder cancer and found that the manufacturer concealed the drug’s significant risks. The jury award in early April 2014 is the largest of its kind in the type 2 diabetes cancer cases.
Thousands of other injured patients have joined a multidistrict litigation (MDL) in Louisiana or mass torts in Illinois and California. The medication is still being prescribed. Experts say Takeda Pharmaceuticals, the inventor and manufacturer of the drug, could face up to 10,000 lawsuits in the United States alone. Many of these cases are beginning trial proceedings.
Experts say that Takeda knew that those taking the medication were at high risk for bladder cancer. Instead of pulling the drug, the company continued to aggressively market it.
In 2006, a study showed that those taking the drug for longer than a year have a 40 percent increased chance of bladder cancer. Regulators in France and Germany pulled the medication from the shelves. U.S. drug regulators changed the drug’s label to include a bladder-cancer warning.
In addition to bladder cancer, the medication is known to cause congestive heart failure in patients both with and without pre-existing heart conditions. It’s also linked to random broken bones and severe liver problems.
Actos Class Action Lawsuits
Actos MDL and mass torts allow injured patients to seek financial remedies. In addition to the $9 billion jury award, a California jury awarded an Actos patient $6.5 million and a Maryland jury awarded a patient’s family $1.7 million. Both verdicts were overturned.
