    Officials: Man dies after cesspool hole collapses in Huntington

    A worker installing a cesspool at a Huntington home Wednesday afternoon was killed after the rim of a freshly dug hole collapsed, burying him beneath a large mound of dirt, Suffolk police said.

    Edward Sinnott, 59, of Huntington, was pulled from the hole just before 7 p.m. police said, and pronounced dead at the scene by a physician assistant with the Suffolk County Medical Examiner’s office.

    Sinnott, who worked for Antorino Sons in Huntington, and other workers, were in the front yard of the home on Beech Place at about 12:50 p.m. when the hole gave way and collapsed into itself, police said. A second worker fell into the hole but got out as the dirt poured in.

    Immediately after the collapse, other members of the crew frantically tried to dig Sinnott out of the pile. First responders from several fire departments soon arrived to help.

    Police blocked off several streets to traffic in the surrounding area, cordoned off the home with yellow tape, and kept gawkers safely away from the scene as efforts to save Sinnott continued.

    Crews used a crane and other equipment, including a tractor-size device designed to suck up large amounts of dirt. By about 2 p.m. as many at the scene realized the likelihood Sinnott had survived faded, residents appeared visibly despondent.

    “I’ve never heard of anything like this,” said Regina Sineno, 51, who lives nearby. “This is very sad.”

    No one answered the phone at the Beech Place home.

    A video shot at the moment the hole collapsed shows a steel crane claw hauling dirt out of the hole as the ground first gives way under Sinnott. Then another worker is shown plummeting into the cascading dirt but he grabs onto the rising claw and is pulled to safety as Sinnott disappears from view.

    Police said the man was not injured.

    Town of Huntington spokesman A.J. Carter said the cesspool “has rings that go into the ground and two rings were in when the worker fell into the hole and it collapsed over him and he got buried.”

    Carter said the worker was directing a crane when the hole collapsed.

    Responders included the Huntington and Huntington Manor fire departments, officials from the Town of Huntington, Suffolk police Second Precinct and Emergency Service Section officers, and Nassau County emergency service officers.

    An official with Occupational Safety and Health Administration arrived at the scene later Wednesday and the agency will investigate the collapse.

    Suspected drunk driver hits ambulance; 3 injured

    FILLMORE TOWNSHIP, Mich. (WOOD) Police say three people, including two paramedics, were injured when a suspected drunk driver hit an ambulance south of Holland early Sunday.

    The crash happened around 4:30 a.m. on Blue Star Highway near 141st Avenue in Allegan County s Fillmore Township.

    According to a release from the Allegan County Sheriff s Office, a pickup truck traveling southbound on Blue Star Highway crossed the center line and hit a northbound AMR ambulance. Police say the driver of the pickup truck appeared to be under the influence of alcohol at the time of the crash.

    AMR identified the paramedic crew as Kevin Jongekryg and Tim Hoffman. Jongekryg was driving the ambulance at the time of the crash and Hoffman was riding in the back and did not have a seat belt on, officials said.

    Both of the men were injured in the crash and were taken by ambulance to Holland Hospital; however, once stabilized Hoffman was then transported to Spectrum Butterworth Hospital in Grand Rapids for a head injury. Hospital officials said Hoffman is in critical condition and Jongekryg is listed in stable condition.

    “The crews of ours that responded this morning, it s a very difficult and traumatic experience for them to respond to friends and coworkers, said Patrick Lickiss, an AMR paramedic and its manager of clinical and education services.

    The driver of the pickup truck was also injured and taken to Holland Hospital before being moved to Spectrum Butterworth Hospital. Police said the truck driver is in serious but stable condition.

    Authorities said no one was being transported in the ambulance at the time of the crash.

    A spokesperson for AMR told 24 Hour News 8 the two paramedics started their shift about a half hour before the crash and were moving post locations in Allegan County when the ambulance was hit.

    Before emergency crews arrived on scene, police said witnesses were able to quickly extinguish a small fire in the engine area.

    Jongekryg is a 23-year veteran with AMR and Hoffman has served for 11 years. AMR says both paramedics have served in multiple roles with the company. Lickiss described the two as caring and giving men.

    I think one of the things that for better or worse kind of unites EMS, is the realization that we are placed at risk, Lickiss said.

    AMR says there are seat belts in the back of the ambulance, but it s not always possible for paramedics to wear them when caring for a patient. However when there is not a patient, it is best practice to wear a seat belt.

    People can see themselves potentially being in a situation like our folks were today both those who work here and those who work elsewhere, Lickiss said.

    Police say the pickup driver s name will not be released pending a review from the prosecutor s office regarding possible charges.

    On July 1, 2014 the Civil department launched its Proposed Order Module in accordance with rule 3.1312 of the California Rules of Court. All proposed orders and/or stipulations and orders are required to be submitted in a Word version along with a PDF. The only exceptions are those orders that are submitted on mandatory judicial council forms. The launching of this module will provide faster turnaround time for orders submitted to the courtroom and signed orders will now be returned via the original transaction submitted.

    The records of the Superior Court of California, County of Orange indicate that a trust fund has money eligible for distribution. These funds were deposited for an arbitration hearing between February 2007 to June 2008.     Innocent Man Freed, Drug Case Dismissed

    Our client was a concrete worker, father of two children and part-time golf caddy charged with selling cocaine to an undercover cop. Rick succeeded in proving that the man selling cocaine in the videotape was not our client, and even actually identified the true culprit.

    Northampton County Court of Common Pleas

    Emiddio Emil Giordano was elected Judge of the Court of Common Pleas of Northampton County on November 4, 2003. He was sworn into office on January 5, 2004. He is the Administrative Judge for Orphans’ Court and presides over civil and criminal trials.

    Judge Giordano is a graduate of Bethlehem Catholic High School (1977), Moravian College (B.A. 1982) and Villanova Law School (J.D. 1985). He was admitted to practice law in the Commonwealth of Pennsylvania in 1986 and in the State of New York in 1985.

    In 1985, Judge Giordano began his career as an Assistant District Attorney in the Broome County District Attorney’s Office in Binghamton, New York. In 1987, he decided to return to the Lehigh Valley area and worked as an associate with the law firm of Holland, Taylor and Sorrentino of Bethlehem until 1988. From 1988 until his election to the Bench, he maintained a private practice, with emphasis on civil, criminal, construction and municipal law.     Plane makes emergency landing on US 31 in Kokomo

    HOWARD COUNTY, Ind. — A small plane made an emergency landing Tuesday on US 31 in Kokomo.

    Authorities say no one was hurt when the plane touched down near Center Road.

    The pilot said he could not make it to the airport.

    A mechanic from the Kokomo Municipal Airport went to the scene, repaired the plane, and the pilot took off.

    The FAA has been notified about the incident.

    Bay Restoration Fee Financial Hardship Exemption — On May 26, 2004, Senate Bill 320 was signed into law, creating the Bay Restoration Fund (�BRF�). The purpose of the bill was to create a dedicated fund financed by wastewater treatment plant users to be used to upgrade Maryland�s wastewater treatment plants with enhanced nutrient removal (ENR) technology. On July 1, 2012, House Bill 446 increased the mandated BRF fee from $2.50 per month to $5.00 per month, and required that BRF fee billing authorities develop a financial hardship fee waiver plan for low income households.

    Residents of the Town of Chesapeake Beach may apply directly to the Town for an exemption from the fee due to substantial financial hardship.

If your dog has a tendency to be aggressive, we suggest you consider a muzzle.

    Reminder on Requirement for Trash Receptacles: According to Town Ordinance 200.3 (9) in part — No garbage, trash, or debris shall be placed out for collection except in proper storage receptacles. Where collection is from a sidewalk or alley, receptacles shall be placed out no earlier than the evening preceding the day of collection. Receptacles placed on a sidewalk or alley shall be promptly returned to the premises after collection. Storage receptacles shall be made of a durable material and shall be watertight with tight-fitting covers to control odor and prevent animal access.

    To start a small claims, download an electronic packet from the right panel by selecting the proper location.

    Who Can Sue and Be Sued? Any individual, business, partnership, or corporation (with a couple of exceptions) may bring a small claims suit for recovery of money only for an amount up to $5,000. A claim can be filed in any King County District Court location, however, small claims cases are only heard in Burien (starting September 2013),Issaquah, Seattle, Shoreline and Vashon. You may select the courthouse location you wish your claim to be heard in as long as other jurisdictional requirements apply. In the case of a traffic accident, or an unlawfully issued check, small claims cases will be filed in the county where the accident occurred or check was issued. Other jurisdictional questions will be answered by a review of RCW 3.66.040 (external site). Questions regarding the statute of limitations in small claims actions can be answered by a review of RCW 4.16 (external site). The State of Washington may not be sued in Small Claims Court. The filing fee for Small Claims is $25 effective August 19, 2014. A portion of your filing fee goes to the King County Dispute Resolution Center.     The Parties Present Their Cases Themselves: Attorneys and paralegals are excluded from appearing or participating with the plaintiff or defendant in a small claims suit unless the judge grants permission. You may consult an attorney before you go to court or after.

    When will the case be heard? Cases are generally heard between 40 and 90 days from the date of filing. You will be given a date and time to appear for your trial. There will be other small claims trials scheduled for the same date and time as yours.

    Typical Cases: Typical cases involve, but are not limited to, auto accidents, property damage, landlord/tenant disputes and collection of personal debts.

    The Trial: Your case will be heard by a District Court Judge, Commissioner or judge pro-tem. A commissioner has all the responsibilities and powers of a judge. A judge pro-tem is an attorney who is hired to fill in for judicial vacations and sick leave. A judge pro-tem also has all the responsibilities and powers of a judge. Each party will have a chance to tell their side of the story. It is important to bring evidence such as photos, witnesses, bills, receipts, contracts or anything else that will prove your case. The judge may decide the case at the time of the hearing or mail it to the parties later.

    If You Want to Appeal a Decision: The party who files a claim or counterclaim cannot appeal unless the amount claimed exceeds $1,000. No party may appeal a judgment where the amount claimed is less than $250. An appeal must be filed within 30 days of the entry of the judgment and all required fees must be paid at that time.

    History of Organization

    BCRC, Inc. was founded in 1962 to provide vocational services for persons with intellectual disabilities. Originally the William Lintz Sheltered Workshop, the agency incorporated in 1971 and became the Beaver County Rehabilitation Center. Paulette Miller became the Executive Director in 1990 Under her leadership, BCRC, Inc. has expanded services for people with a wide range of disabilities.

    BCRC, Inc. is accredited by the Department of Public Welfare to operate a work activity center and by the United States Psychiatric Rehabilitation Association to operate psychiatric rehabilitation services for persons who are mentally ill.

    Mission Statement

    The Jail Bureau of the Monroe County Sheriff’s Office currently operates three facilities: a pre-trial detention facility that houses approximately 1,000 inmates in downtown Rochester, a sentenced facility in suburban Brighton, New York, that houses 475 sentenced inmates, and a regional forensic unit at the Rochester Psychiatric Center.

    Visiting an Inmate

    Each inmate housed at the Monroe County Jail and Monroe Correctional Facility is permitted two one-hour visits each week by appointment.

    Downtown visits may be scheduled in person or by calling 753-4000 beginning at 8:45 a.m. until all appointments are filled. All visits are scheduled one week in advance; there are no walk-in visits available. Visits will be scheduled on Monday for the following Monday, Tuesday for the following Tuesday, Wednesday for the following Wednesday, Thursday for the following Thursday, and Friday for the following Friday and.

    Inmates who have Trustee Status are allowed to request a permanent visit time which will automatically be scheduled each week once they are approved. Permanent visit times are granted based on the availability of space and the inmate’s status.

    All visitors must arrive at least 15 minutes prior to their scheduled visit time. If you are not on time, your visit may be cancelled.

    You must have a valid government issued photographic identification to enter the visiting area such as a NYS Drivers License, Non Driver I.D. card or Benefit Card.

    The United States Department of Justice adopted the National PREA Standards to Prevent, Detect, and Respond to sexual abuse and sexual harassment in juvenile detention, prisons and/or jails, lockups, and community confinement facilities.On June 20, 2012, the Department of Justice officially published the finale PREA standards for the four types of facilities: Juvenile Detention, Prisons and/or Jails, Lockups, and Community Confinement Facilities. The Monroe County Sheriff’s Office has actively been implementing the PREA standards through policy, education, and good working strategies with the goal of preventing sexual abuse and/or sexual harassment in its facilities.The Monroe County Sheriff’s Office has zero tolerance toward all forms of sexual abuse and sexual harassment involving any employee, volunteer, contractor, or inmate. All reports of sexual abuse, sexual harassment, and any possible retaliation for reporting sexual abuse or sexual harassment will be thoroughly and objectively investigated to completion.Third-party reporting of sexual abuse and sexual harassment can be made 24 hours a day to the Monroe County Jail Administration Office at (585) 753-4178.A delay in reporting an incident will place the safety of any inmate in jeopardy and make the investigation of the incident far more difficult.Annual statistical data reports will be available for public display at the Monroe County Jail Property/Jail Records lobby and the Monroe County Correctional Facility lobby.

    Addison, age 6, came to CRC after her step-dad was arrested for attacking her mother. After years of witnessing abuse, she was aggressive towards the other children, often hitting and getting frustrated. Addison worked with a marriage and family therapist and art therapist to process her feelings. She also worked with the Therapeutic Children’s Center staff who recognized her delayed speech and hearing loss. After much advocacy, Addison’s hearing was tested and she was provided hearing-aids. Today, Addison is attending a specialized school for deaf and hard-of-hearing students and has significantly progressed in her ability to communicate and get her needs met with greatly reduced aggression.

    At 16 years old, Kristen came to CRC when in her first relationship. With a jealous boyfriend who always wanted to know where she was, she had a hard time telling between love and abuse. With courage, Kristen broke up with her boyfriend and continued therapy. She learned about healthy relationships, red flags and warning signs, and most importantly, improved her relationship with herself. She recognized the cycle of abuse in her parents’ relationship and knew she wanted something different for herself. Now in college, Kristen has the vision for a healthy relationship for herself and her future.

    Before coming to CRC Kelly was starving and her daughter had moved out, impacting her finances. She was not able to afford buying nutritional food, only what was cheap, and her health was suffering. Now she eats better, loves the selection of the fresh food choices and she can tell that her health is much improved.

    VIDEO: San Mateo County First Chance program gives DUI drivers jail or unlocked dorm

    SAN MATEO COUNTY (KRON) So you have made the mistake of driving under the influence. What next?

    Well, there are two possibilities. The officer, at his or her discretion, could give you a choice between spending a night in jail or an unlocked dorm.

    That option has been available in San Mateo County for almost 25 years, made possible by a program called First Chance.

    A rough night out for one man who was stopped and arrested by police for drinking and driving.

    And he was brought to a sobering station in Burlingame where the doors are unlocked and there is no security.

    The idea was treatment rather than incarceration, First Chance Program Director Janel Guinane said.

    First Chance is a program operated by the non-profit organization StarVista in San Mateo County.

    Guinane says since the program started nearly a quarter century ago, some 60,000 people have been treated here.

    It can happen to anyone, you know, a lot of times it s not the chronic alcoholic that gets pulled over for DUI, Guinane said. It s someone who makes the mistakes, someone who miscalculates how much they ve had, someone who drinks, you know, just a little bit over the limit. And someone who never does it again.

    The sobering station, as it s called, is open 24 hours a day, seven days a week.

    It s up to the arresting officer whether the intoxicated person is brought here or taken to the main jail in Redwood City.

    The San Mateo County Sheriff s Office adds though that that person can t have a history of violence.

    The doors are not secured, so if I leave you at First Chance, you could walk out, Det. Sal Zuno said. Now, if that happens, all they re going to do is they re going to call us, and call the police and say this person who you just booked into First Chance just walked out the door, and you re going to get into more trouble and more charges.

    San Mateo County District Attorney Steve Wagstaffe says almost all law enforcement agencies in the county are involved in the program.

    Those agencies pay a fee each year based on the size of their city or town, totaling about $800,000 combined, which keeps the program running.

    They re still cited, and the police agency will refer the case to my office, Wagstaffe said. We ll file misdemeanor charges on the person. They come to court just the same as if they d been booked into the county. The only difference is that they re not booked into the county jail, they re taken to the First Chance program.

    Wagstaffe says programs like this are partly the reason why there is no jail overcrowding in San Mateo County.

    And he says it is especially helpful to agencies like the Pacifica Police Department which doesn t even have a jail, just holding cells.

    They don t have to take an officer off the street for 3 or 4 hours while they drive the person down here to Redwood City to book them in, go through all that process, and then drive back to Daly City or Pacifica, Wagstaffe said. So, it s been a wonderful program and law enforcement pays for it.

    All employees at First Chance are also licensed or registered councilors.

    It s a wonderful thing, Guinane said.

    And they help DUI offenders get treatment during and after their stay.

    Leavitt v. Brockton Hospital, et al. 454 Mass. 37, 907 N.E.2d 213 (2009) limits the potential liability of medical providers to non-patient third parties, holding that generally medical providers have no duty to detain or control their patients.

    City of Dallas Traffic Tickets
    City of Dallas traffic tickets, which are issued by City of Dallas Police Officers, are handled in the City of Dallas Municipal Court. Dallas County traffic tickets, which are issued by Dallas County Constables or Sheriffs, are handled in the Dallas County Justice of the Peace Courts.

    After receiving a Dallas traffic ticket in the City of Dallas, you have twenty-one days to pay your ticket or appear in court and enter a plea. In other jurisdictions / municipalities, the appearance date varies. If you do not make an appearance, a Dallas warrant will be issued for your arrest and your fine will increase. In addition, the Court may issue an additional offense known as a Failure to Appear.

    The only way to dispose of this warrant is to post a cash bond for the fines owed or hire an Dallas ticket attorney who can post a bond on your behalf so you do not have to come up with the money for the outstanding fine.     2013 Conforming And Jumbo Loan Limits For Every U.S. County

    Current as of November 18, 2015. The jumbo and conforming loan limits provided below reflect 2013 loan limits. If you get your local jumbo and conforming loan limit information somewhere else, make sure that source is accurate and up-to-date.

    What Is A Conforming Mortgage “Loan Limit”?

    A “conforming mortgage” is so named because its loan traits — quite literally — “conform” to the loan rules set forth by Fannie Mae or Freddie Mac.

    Fannie’s and Freddie’s mortgage guidelines are dense, covering thousands of home loan traits, but there is one over-reaching rule — neither Fannie Mae nor Freddie Mac will securitize a mortgage that’s considered “too big” for its books.

    Defining “too big” is an annual decision-making process based on the economy and home price data. The debate results in a “loan size limit”; the maximum amount of mortgage that Fannie and Freddie will allow, per their respective home loan guidelines.

    Loan sizes up to these maximum amounts can be conforming mortgages. Loan sizes beyond the conforming loan limit are often considered “jumbo”.

    2013 Mortgage Loan Limits. $417,000 – $625,500

    2013 conforming loan limits are the same as from 2012, 2011, 2010, 2009, 2008, 2007 and 2006, with loan limits varying by property-type.

    As he number of “units” increase for a property, its conforming loan limit rises.  1-unit homes have the smallest conforming loan limit, a  classification which includes single-family residences of all types —  detached homes, row homes, town homes, condos and co-ops.

    Multi-unit homes get access to larger loan sizes.

    • 1-unit properties. 2012 conforming loan limit of $417,000
    • 2-unit properties. 2012 conforming loan limit of $533,850
    • 3-unit properties. 2012 conforming loan limit of $645,300
    • 4-unit properties. 2012 conforming loan limit of $801,950

    Note that these limits are for conforming mortgages only. FHA loan limits — including for the FHA Streamline Refinance — use different scale. The FHA, for example, allows up to $729,750 for a 1-unit property.

    “High-Cost Areas” Can Borrow Up To $625,000 For 1-Unit

    The 2013 conforming mortgage loan limit, as established by Fannie Mae and Freddie Mac, does come with exceptions. Specifically, for areas designated as “high-cost”.

    A high-cost area is exactly what it sounds like — a city, town or county in which homes are more “expensive” as compared to national and regional averages.

    For example, Loudoun County, Virginia along with the rest of Washington, D.C. Metro area (e.g.; Potomac, MD; Bethesda, MD; Alexandria, VA) are considered high-cost, as is nearly all of California, and areas including Eagle County, Colorado in which conforming loan limits extend to $625,500.

    Not all high-cost areas allow up to $625,500, though. The tony enclave of Athens, Ohio — home to Miami University — gets the high-cost treatment but with a conforming loan limit of just $432,500.

    Not all “expensive” areas are designated high-cost, however.

    Despite home prices rivaling those of San Francisco, Malibu and New York City, the city of Chicago fails to earn the high-cost loan limit treatment, as does its surrounding luxury neighborhoods which includes Highland Park, Winnetka, and Hinsdale.

    The same is true for Lower Merion, Pennsylvania — a Philadelphia suburb recently named the fifth-highest earning suburb in the country, and in which the median home sale price is $553,500.

    Like the Chicagoland area, which extends south through Calumet City, north through Waukegan and west through Joliet, the median home price in Lower Merion’s metropolitan statistical area is lowered by its surrounding towns.

    In Lower Merion, Pennsylvania, as in Chicago, Illinois, the local conforming loan limit is $417,000. Loans in excess of that amount are considered jumbo.

    No Exceptions. Loans Between $625,500 – $729,750

    With its 2013 Loan Limits release, the government left an unintended consequence of its various stimulus programs untouched

    With names like the American Recovery and Reinvestment Act of 2009, Public Law 111-88, and Public Law 111-242, these programs temporarily raised the conforming loan limits in high-cost areas to as much as $729,750 beginning July 1, 2007 and lasting through September 30, 2011.

    Effective October 2011, though, loan limits returned to $625,500, leaving scores of homeowners with new conforming mortgages too big to get refinanced. As mortgage rates have dropped, this “unrefinanceable” problem has been more pronounced. HARP 3 may address this issue, if HARP 3 — also known as #MyRefi — comes to pass.

    HARP is the mortgage for underwater homeowners.
