Nondiscrimination in Small Group Market

A small group is considered a business with 50 or fewer employees, and if they offer health insurance to their workers, they are subject to various state laws. The Small Employer Health Insurance Availability Program (CRS 10-16-105.2) was enacted in 1994 by the General Assembly in order to prevent an imbalance in state and private programs. This law states that the small group market must not insure only healthy workers and therefore flood the CoverColorado risk pool with more pre-existing conditions than it can handle. This law requires small group laws to apply to any health insurance plan offered by a small Colorado company if they meet any of the criteria below.

Colorado small business health insurance

1. A percentage of the premium or benefits is covered by or on behalf of the small business;

2. A qualifying worker or dependent is reimbursed through payroll adjustments or other means, by or on behalf of the business for a percentage of the premium;

3. The health insurance policy is treated by the employer or any of the eligible employees or dependents as part of a plan or program for the purposes of Section 162, Section 125 or Section 106 of the United States Internal Revenue Code; or

4. The health insurance policy is offered by an employer to their workers.

The Colorado Department of Regulatory Agencies Division of Insurance continues to define small group coverage in the same way as CRS 10-16-105.2: If a small employer gives each employee an allotment to buy his or her own coverage, such coverage is considered small group coverage.

Health Reimbursement Arrangements (HRAs)

Offered through federal tax laws to businesses of all sizes, with the exception of one-man groups, health reimbursement arrangements (HRAs) are paid for by an employer, allowing workers to get reimbursed for certain medical costs. These plans are tax-advantaged liked a health savings account (HSA), being tax-deductible for both businesses and their employees.

Throughout Colorado, small companies are offering HRAs instead of a health insurance plan. These reimbursement plans are then used by employers to help employees pay premiums for individual health plans. Colorado individual insurers are discouraged from selling coverage to a member of a small group s HRA when their premiums will be reimbursed. If the HRA is being used to help pay premiums for employees, it is then required to follow small group laws.

Individual Market Small Group Market Differences

Individual health plans are permitted to deny coverage, exclude benefits for a pre-existing condition, and determine an applicant s premium based on their current or past health problems, according to Colorado law. Some services are not required to be offered by an individual health plan, such as maternity and mental health care. However, the small group insurance market is different, bound by several laws to guarantee issue health plans, adjust premiums based on the whole group, and not discriminate premiums due to health.

The Master of Public Health (M.P.H.) Degree Program prepares students at Jackson State University to become competent practitioners in different areas of public health including behavioral health promotion and education, epidemiology, and health policy and management. The worst private health insurers have been revealed by a new analysis that shows some of the leading insurers, including Medibank and NIB, are not the most generous of all.

A new league table created by the Australian Medical Association has exposed what health insurers pay for 22 common procedures, including cataract surgery, tonsil removals, colonoscopies and births.

It shows a large variation in payments for the same procedures, suggesting some policy holders are more likely to face out-of-pocket fees than others. For example, HBF pays $2150 for an uncomplicated delivery of a baby while GMHBA pays $832 – a difference of 158 per cent.

The Private Health Insurance Report Card – the first in a series the AMA plans to release – found HBF paid the most for nine of the 22 procedures, and MDHF​ and GMHBA​ paid the lowest amount for 19 of the 22 procedures that were compared.

The second best insurer was AHSA (Australian Health Service Alliance), which includes 30 smaller players such as Defence Health, Australian Unity Health, and the Teachers Health Fund. AHSA​ funds paid the most for eight of the 22 procedures, including colonoscopies, knee replacements, breast biopsies, and coronary artery bypass operations.

The analysis will help people compare their health insurance ahead of premium rises on April 1. While federal Health Minister Sussan Ley recently announced that she had approved premium rises averaging 5.59 per cent, consumers are reporting increases of 8 to 9 per cent for funds including Bupa and Medibank.

AMA president Brian Owler said people often found themselves paying “gap” payments for procedures because insurers set the amount they pay for a medical service. Because different insurers pay different amounts, he said people face varying out-of-pocket fees.

However, doctors can also charge private fees that are higher than what their peers charge and higher than what the insurer pays. This can also result in other fees.

“The AMA wants Australians to know their insurance product – and know it thoroughly,” Professor Owler said.

“With the cost of private health insurance constantly rising, and with private health insurers regularly changing what is covered and not covered by their products, the AMA believes it is important that families and individuals are better informed about the health insurance cover they are purchasing.”

Professor Owler, a surgeon, said people should be wary of health insurance policies that only cover public hospital treatment. He referred to them as “junk policies” because they do not support patient choice of doctor or timing for health services or procedures. In public hospitals, all Australians can be treated for free.

“If people have one of the junk policies, the AMA urges them to consider carefully what cover they really need.”

Professor Owler said people should also be cautious about misleading policy names that imply a higher standard of cover when they only cover basic services. He also warned people to be wary of comparator sites that can earn “exorbitant fees per sale from the insurers”.

“The insurer may be paying a commission to the site, either as a fixed percentage of the premium, or as a set fee per sale. These fees can make up a sizeable proportion of the total insurance premium,” he said.

“There needs to be a greater level of transparency, and the government and regulators need to scrutinise these sites.”

A Medibank spokesman defended the performance of the company, saying the report only told part of the story.

“We acknowledge that not all Medicare Benefits Schedule fees set by the government have kept pace with inflation or medical practice costs over the last 30 years, which is why we have agreed no gap rates,” said the spokesman.

“However this is not the only cost incurred by funds. In fact specialist fees are often a relatively small component of the cost of a procedure and health insurers are also required to pay substantial amounts to hospitals, which have not been published by the AMA in their report.”

A pre-existing condition is one where signs or symptoms of your ailment, illness or condition, in the opinion of a medical practitioner appointed by GMHBA (not your own doctor), existed at any time during the six months preceding the day on which you purchased your hospital insurance or upgraded to a higher level of hospital cover and/or benefit entitlement.

A special waiting period applies to obtain benefits for hospital treatment for new members who have pre-existing conditions. The waiting period also applies to existing members who have recently upgraded their level of hospital cover. If the ailment, illness or condition is considered pre-existing:

New members must wait 12 months for any hospital benefits (other than psychiatric, rehabilitation and palliative care).

Existing members (transferring or upgrading)

Members transferring/upgrading to a higher hospital cover must wait 12 months to get the higher hospital benefits (other than psychiatric, rehabilitation and palliative care).

Existing members (with at least 12 months membership)

Existing members with at least 12 months membership in total across their old and new cover are entitled to the lower benefits on their old cover.

During your first 24 months of cover – after the standard hospital waiting periods have been served – Best Hospital and Best Hospital (no pregnancy) covers have benefit limitations on selected services.

This means that the benefits payable on these services are limited to the minimum shared room rate under the Private Health Insurance Act for private hospital admissions during the 24 month benefit limitation period.

Once the waiting period and benefit limitation period has been served you will have access to the benefits applicable on your level of cover.

Silver Hospital cover provides the same single room coverage as Gold Hospital, but co-payments of $100 per day up to a maximum of $700 per admission apply. Co-payments are not the same as hospital excess. Please note: Some private hospitals only have single rooms and co-payments will apply.

Co-payments do not apply.

When Can You Claim a Tax Deduction for Health Insurance?

Each year, June 28 marks National Insurance Awareness Day, serving as a reminder that it’s a good time to review your insurance coverage and ensure that it still fits your needs.

This is particularly true for health insurance and making sure you have the right amount of coverage at an affordable cost.

Health insurance can be expensive, so being able to claim a tax deduction for some of your insurance costs can help you save come tax time.

Since there are specific rules and qualifications you must follow, here’s an overview of when you can and cannot claim a tax deduction on your health insurance.

When health insurance is not tax-deductible

If you didn’t pay for health insurance, you can’t take a tax deduction for it. If your employer pays your health insurance premiums, you can’t deduct those costs. However, if an employer only pays for part of your premiums, you still may be able to claim a tax deduction for the portion you paid.

If you received a subsidy or premium tax credit to purchase an insurance plan in the Health Insurance Marketplace through the Affordable Care Act, any advanced-payment subsidy that lowered the cost of your health insurance premiums cannot be claimed as a tax deduction. However, the money you paid out of your own pocket for your premiums might be tax deductible.

You can’t take a deduction for health insurance you paid for with pre-tax money. If you have insurance through your employer, the premiums you pay are usually taken out of your paycheck before your income taxes are calculated. Since these premiums are paid with pre-tax dollars, they’re already income-tax-free, meaning you can’t claim them as a tax deduction.

Also note, you can not deduct health insurance unless you itemize your tax deductions or you are self-employed. You don t need to know if you qualify for itemized tax deductions, TurboTax will figure it out for you.

When health insurance is tax-deductible

If you’re self-employed, your health insurance premiums may be tax deductible. If you’re self-employed and not eligible for an employer-sponsored health plan through a spouse’s job, you may be eligible to write-off your health insurance premiums on your taxes. However, you can’t write off more in health insurance premiums than you earned.

Health insurance premiums paid with your own after-tax dollars are tax deductible. For example, if you purchased health insurance on your own through a health insurance exchange or directly from an insurance company, the money you paid toward your monthly premiums can be taken as a tax deduction.

Some Medicare plans are tax deductible. This includes Medicare Part B and Part D prescription coverage.

There are limits to the amount of your health insurance you can deduct. If you are able to write-off your health insurance, there are limits to how much of your premiums you can write off.

If you’re able to claim your health insurance as a medical expense deduction. you can only deduct medical expenses that exceed 10% of your adjusted gross income (7.5% if you’re 65 or older). If you’re self-employed and claimed the self-employed health insurance deduction, you don’t have to exceed the 10% threshold because you’re writing the premiums off as an adjustment to your self-employment income rather than as a tax deduction deduction.

Welcome to the Counseling Center

END OF THE SEMESTER SESSIONS

Each semester, when the Counseling Center has no more capacity to add new clients seeking ongoing counseling, we replace initial consultations (ICONs) with one-time sessions for the remainder of the semester. As of Monday, July 31 st the Counseling Center will begin offering one-time sessions. These one-time sessions are an hour in length and focus on problem solving more immediate issues. If students are in need of further services, we will help them connect with additional resources outside of the Counseling Center.

Counseling Center services are free, confidential, and provided by trained professionals to currently enrolled Texas State students while classes are in session.

Counseling Center Services include brief individual, group, and couples counseling, consultation and crisis response, and workshops about coping with stress and other mental health topics.

    Rule requires engineering controls to keep workers from breathing silica dust

    The Occupational Safety and Health Administration (OSHA) has issued a final rule to curb lung cancer, silicosis, chronic obstructive pulmonary disease and kidney disease in America’s workers by limiting their exposure to respirable crystalline silica. The rule is comprised of two standards, one for Construction and one for General Industry and Maritime.

    OSHA estimates that the rule will save over 600 lives and prevent more than 900 new cases of silicosis each year, once its effects are fully realized. The Final Rule is projected to provide net benefits of about $7.7 billion, annually.

    About 2.3 million workers are exposed to respirable crystalline silica in their workplaces, including 2 million construction workers who drill, cut, crush, or grind silica-containing materials such as concrete and stone, and 300,000 workers in general industry operations such as brick manufacturing, foundries, and hydraulic fracturing, also known as fracking. Responsible employers have been protecting workers from harmful exposure to respirable crystalline silica for years, using widely-available equipment that controls dust with water or a vacuum system.

    Key Provisions

    • Reduces the permissible exposure limit (PEL) for respirable crystalline silica to 50 micrograms per cubic meter of air, averaged over an 8-hour shift.
    • Requires employers to: use engineering controls (such as water or ventilation) to limit worker exposure to the PEL; provide respirators when engineering controls cannot adequately limit exposure; limit worker access to high exposure areas; develop a written exposure control plan, offer medical exams to highly exposed workers, and train workers on silica risks and how to limit exposures.
    • Provides medical exams to monitor highly exposed workers and gives them information about their lung health.
    • Provides flexibility to help employers especially small businesses protect workers from silica exposure.

    Compliance Schedule

    Both standards contained in the final rule take effect on June 23, 2016. after which industries have one to five years to comply with most requirements, based on the following schedule :

    Construction – September 23, 2017. OSHA delayed enforcement in order to conduct additional outreach and provide educational materials and guidance for employer. See the memorandum .

    General Industry and Maritime – June 23, 2018, two years after the effective date.

    Hydraulic Fracturing – June 23, 2018, two years after the effective date for all provisions except Engineering Controls, which have a compliance date of June 23, 2021.

    Background

    The U.S. Department of Labor first highlighted the hazards of respirable crystalline silica in the 1930s, after a wave of worker deaths. The department set standards to limit worker exposure in 1971, when OSHA was created. However, the standards are outdated and do not adequately protect workers from silica-related diseases. Furthermore, workers are being exposed to silica in new industries such as stone or artificial stone countertop fabrication and hydraulic fracturing.

    A full review of scientific evidence, industry consensus standards, and extensive stakeholder input provide the basis for the final rule, which was proposed in September 2013. The rule-making process allowed OSHA to solicit input in various forms for nearly a full year. The agency held 14 days of public hearings, during which more than 200 stakeholders presented testimony, and accepted over 2,000 comments, amounting to about 34,000 pages of material. In response to this extensive public engagement, OSHA made substantial changes, including enhanced employer flexibility in choosing how to reduce levels of respirable crystalline silica, while maintaining or improving worker protection.

    What is Vivitrol?

    Loan Facilities for Short Term Agricultural Operations

    Crop Loans are also called short term loans for “Seasonal Agricultural Operations.” The Seasonal Agricultural Operations connote such activities as are undertaken in the process of raising various crops and are seasonally recurring in nature. The activities include, among others, ploughing and preparing land for sowing, weeding, transplantation where necessary, acquiring and applying inputs such as seeds, fertilizers, insecticides etc. and labour for all operations in the field for raising harvesting the crops. Thus, the credit required to meet the current expenditure for raising the crops on land till the crops are harvested is construed as production or short term credit for seasonal agricultural operations.

    Kisan Credit Card Scheme

    Crop loans are generally disbursed by the banks through the mode of Kisan Credit Card (KCC). The Kisan Credit Card Scheme is in operation throughout the country and is implemented by Commercial Banks, Cooperative Banks and RRBs. All farmers including small farmers, marginal farmers, share croppers, oral lessees and tenant farmers are eligible for issuance of KCC. KCC holders are also covered under Personal Accident Insurance Scheme (PAIS) against accidental death/permanent disability. Bank assesses farmer’s eligibility on the basis of land available for cultivation and the scale of finance fixed by the District Level Technical Committee in that district and the credit history of the farmer. The scope of the KCC has recently been broad-based to include term credit and consumption needs. Government has advised the banks to convert Kisan Credit Card into a Smart Card cum Debit Card.

    Some of the main features of KCC scheme are :

    • Assessment of crop loan component based on the scale of finance for the crop plus insurance premium x Extent of area cultivated + 10% of the limit towards post-harvest / household/consumption requirements + 20% of limit towards maintenance expenses of farm assets.
    • Flexi KCC with simple assessment prescribed for marginal farmers.
    • Validity of KCC for 5 years.
    • For crop loans, no separate margin need to be insisted as the margin is in-built in scale of finance.
    • No withdrawal in the account to remain outstanding for more than 12 months; no need to bring the debit balance in the account to zero at any point of time.
    • Interest subvention /incentive for prompt repayment to be available as per the Government of India and / or State Government norms.
    • No processing fee up to a limit of Rs. 3.00 lakh.
    • One time documentation at the time of first availment and thereafter simple declaration (about crops raised/ proposed) by farmer.
    • KCC cum SB account instead of farmers having two separate accounts. The credit balance in KCC cum SB account to be allowed to fetch interest at saving bank rate.
    • Disbursement through various delivery channels, including ICT driven channels like ATM/ PoS/ Mobile handsets.

    Rate of interest and collateral requirement on crop loans

    In terms of Govt. of India instructions for 2013-14, all the crop loans upto Rs. 3 lakh are being disbursed at the interest rate of 7% p.a. Govt. of India also provides interest subvention of 3% p.a. to prompt repaying farmers, thus making available the crop loans to them at 4% p.a. To bring more and more farmers within the institutional credit fold, Government has extended this scheme to crop loans borrowed by farmers from Private Sector scheduled commercial banks in respect of loans given within the service area of the branch concerned.

    Crop loans beyond Rs. 3 Lakh are being disbursed by the banks at the rate of interest as per RBI and other conditions as approved by their Board of Directors. In terms of RBI instructions, no separate security is required for crop loans upto Rs. 1 Lakh. Beyond Rs. 1 lakh the security is decided by the individual bank in terms of RBI guidelines.

    Next in my series on How To Fully Fund Your PhD. I provide a list below of universities that offer full funding to all students admitted to their doctoral programs in education, international education, and educational leadership.

    You can find several competitive, external fellowships in the ProFellow database for graduate and doctoral study, but it is useful to seek out PhD programs that offer full funding to all admitted students. When a doctoral program indicates that they provide full funding to their PhD students, in most cases this means they provide each admitted student full tuition and a stipend for living expenses for the four to six year duration of the student’s doctoral studies. Not all universities provide full funding to their doctoral students, which is why I recommend researching the financial aid offerings of all the potential PhD programs in your academic field, including small and lesser-known schools both in the U.S. and abroad.

    Harvard University, Graduate School of Education, PhD in Education (Cambridge, MA): Harvard provides full financial support for PhD students for all five years of the program.

    New York University, Steinhardt School of Culture, Education and Human Development (New York, NY): NYU Steinhardt awards all students (including international students) who are offered full-time admission to our PhD programs a full funding and mentoring package.

    Queen s University, School of Graduate Studies, PhD in Education (Ontario, Canada): Queen’s guarantees a minimum funding package currently valued at $18,000 [CAD] per year for fours years for full-time doctoral students; in most cases, funding packages are higher (2011-12 average: $25,800). In addition, Queen’s guarantees an international tuition award (or equivalent award) valued at $5,000 per year for four years for eligible international doctoral students.

    University of California Irvine, PhD in Education (Irvine, CA): Effective 2015, all incoming UC Irvine PhD in Education students, including California residents, non-residents, and international students, are offered five years of financial support. Funding includes an academic year stipend or salary, tuition and Student Services Fee waiver, and student health insurance.

    University of Colorado, School of Education (Boulder, CO): Admitted doctoral students received four-year funding packages including a stipend and a tuition grant equal to the cost of tuition (in-state and out-of-state).

    Tracy, I have not been able to find any so far. Online programs are typically offered by for-profit universities. However, if you can find a 3-year PhD position that does not require the normal 2 years of course (typically you need to have a Master s/postgraduate degree already to be eligible for these), you may not need to be in-resident. These programs are more common in Europe, Asia and Oceania. Thus you might spend some time abroad to get started, and then could complete your PhD dissertation remotely. This would require negotiation with your supervisors.

    Try Colorado State University, their program is fairly new (10) but they have some online portion and a short residency program.

    This Woman Has Cholinergic Urticaria, A Condition That Makes Her Allergic To Her Own Sweat

    Julie Reid has refused to leave her apartment during the daytime for the past three years, which is rare in sunny Clearwater, Fla. As a former gymnast and dance instructor, much of Reid’s life was devoted to physical activity and putting on a show for people. That was until she developed a disorder that left her allergic to her own sweat. Today, she spends the majority of her time avoiding the sun and people.

    “I’ve lived in Florida for eight-and-a-half years now,” Reid wrote on a website that chronicles her harrowing experience. “Three years ago, in March 2013, I was working at a gymnastics gym for my fourth year in a row, and I was also a dance teacher. And I loved my life. And out of nowhere, I developed a rare skin condition called cholinergic urticaria. I am allergic to my own sweat. [And tears.]”

    Cholinergic urticaria is a hypersensitive skin condition characterized by an immediate reaction triggered by heat, emotional stress, or exercise. Although dermatologists know the episodes are caused by environmental factors that raise our temperature and cause sweating, what causes people to develop this condition is unknown. Like most people who have it, Reid has no idea where it came from. The hives that break out all over her skin are painful and can last for days. Aquagenic urticaria is a similar condition in which hives are triggered by water.

    Since her diagnosis, Reid has lost her job and gained more than 100 pounds. She doesn’t go outside in order to avoid the Florida heat and the stares of people looking at her hives. Most days she doesn’t even feel like getting out of bed and she says she recently started to exhibit symptoms of depression and agoraphobia. Not only is Reid out of work, but she has also lost her health insurance and was denied disability.

    “I have not worked in three years because it is physically impossible for me,” she said. “I wake up covered in hives every day, even though I have the air conditioner on. I have laid in bed for the last three years straight to avoid sweating, and it breaks my heart every single day. I miss my old life so much. One without itching and without pain. I even dream about it. But when I wake up, only then does it turn into a nightmare.”

    Reid started her website about living with cholinergic urticaria to help spread awareness of the condition and the people suffering from it. Bouts of hypersensitivity to heat can stop as quickly as they started, but there is no universal timeline for how long symptoms can last.

    Treatment options are also scarce and underresearched. Although doctors may prescribe antihistamines to reduce itching and redness, some patients take a proactive approach that includes protective clothing, sunscreen, or in Reid’s case, avoiding the sun altogether and staying in a cool place.

    Other matters growing in importance among the Most Wired hospitals and health networks include using data to make the transition from volume-based to value-based reimbursement; helping to connect hospitals in remote locations with specialists via video or audio; and continuing to work to make electronic health records more useful and shareable among different hospitals and health systems.

    But the protection of valuable health care data is at or near the top of chief information officers priority lists. The way [criminals are] getting in primarily is through phishing emails, says Lynn Sessions, a partner with law firm BakerHostetler. What happens is a health care employee gets an email thinking it s a legitimate email. And these are very convincing emails. And they end up giving up their username and password, Sessions says.

    Hospitals and health systems are fighting back in response to the threats presented by hackers, putting more resources into defensive systems and employee education, according to the results of this year s survey.

    Most Wired-designated participants already were big users of defensive measures such as intrusion detection systems every year since 2013, at least 92 percent of them used such approaches. Now, Most Wired hospitals and health systems are taking more aggressive steps to beat back the hordes of hackers and hacking programs searching for a way into hospitals information technology systems. Sixty-seven percent of Most Wired hospitals and health systems are using pattern detection to prevent automated logins, compared with 60 percent in 2015 and just 48 percent in 2013.

    A less-discussed but still important threat that the hospital field is addressing concerns what s called social engineering. The practice entails using personal interaction such as posing as a co-worker or family member to obtain password information or some other means to crack into a hospital s data.

    When we do a security assessment, we look at technical security, the basics like bits, bytes and wires, says Munzoor Shaikh, a director in the health care practice of consulting firm West Monroe Partners, Chicago. But beyond the bits, bytes and wires, there s a lot of internal security measures that actually have to do with the human and the process side. Hospitals should have some type of process to limit that kind of risk, he says.

    Among Most Wired hospitals, 40 percent perform annual social engineering risk assessments, 28 percent perform unannounced assessments and 7 percent perform assessments quarterly. Eight percent perform such assessments no more frequently than every two years, and 17 percent never do, according to Most Wired data.

    Dialing up care

    The Most Wired hospitals and systems in the survey are users of telehealth to varying degrees, but experts say telehealth, in its different forms, is on the upswing, despite being hindered by reimbursement limitations. Telehealth is getting a lot more interest, says Chantal Worzala, vice president for health information and policy operations with the American Hospital Association.

    Part of the interest is driven by increased consumer understanding of how much more convenient it can be to interact with others using devices such as smartphones, and health care follows that trend, Worzala says.

    Another driver of the growth in telemedicine comes from the inpatient side of care, where telemedicine can limit the effects of caregiver shortages, she says. The same holds true for behavioral health care.

    Among those designated as Most Wired hospitals and health systems, the most popular use of telemedicine is for consultations and office visits (61 percent), while the use of telemedicine for rehabilitation (17 percent) was least cited by hospitals.

    Among the Most Wired, use of telemedicine for psychiatric examination or psychotherapy in the hospital setting involved close to half of respondents at 47 percent.

    Telemedicine would be improved by modernization of Medicare s handling of such care. It s extraordinarily limited in what will be covered, Worzala says.

    Analytics use growing

    Meanwhile, the use of IT data to better care for patients and patient populations continues to grow in popularity. Analytics is picking up very, very nicely, says Marc Probst, chairman of the College of Healthcare Information Management Executives and chief information officer for Intermountain Healthcare, Salt Lake City.

    Probst notes that analytics used to be the domain of just a handful of academic organizations that were able to use the data they were collecting to conduct strong analyses and make better decisions for clinical and even financial practices. That capacity is spreading, he says.

    We re seeing a tremendous uptick in capability and use. That s a neat opportunity, Probst says.

    The survey data back up that view, with less than half (41 percent) of Most Wired hospitals and systems performing advanced analytics such as conducting controlled experiments or scenario planning and some form of forecasting.

    But 91 percent of Most Wired respondents are performing business intelligence analyses in a single department, and 82 percent of all respondents are.

    The practice of performing population health analysis with IT as its backbone also is still in the growth phase. The percentage of Most Wired hospitals and systems performing different aspects of pop health management implementation ranged from 48 percent that are synchronizing clinical and financial risk measures for clinical, operational and compliance standards to 84 percent that are identifying and targeting patients for outreach.

    Look for the use of these practices to grow sharply as the field transitions to value-based care models. Most folks would consider the analytics capability for a value-based environment to be an absolutely critical, necessary building block to be successful, says Scott Ransom, M.D. managing director of strategic solutions for Navigant Consulting.

    Integration of data for practical applications has room to grow and potential for great benefits. Fifty-nine percent of the Most Wired integrate clinical and claims data so they are accessible, searchable and reportable across the care community.

    Data management cuts costs

    Managing data properly helped Mercy, Chesterfield, Mo. when the large health system used clinical data to cut perioperative costs, and Mercy is applying what it learned in that area to other parts of its operations.

    In every health care organization, IT as well as the operations and clinical side are looking at ways to drive expense out of the organization, says Gil Hoffman, chief information officer with Mercy. Data play a role in that, figuring out ways we can do things more efficiently and still have the very, very best patient outcomes, Hoffman says.

    Mercy improved efficiency to the tune of $9 million by reworking its purchasing practices using supply cost data in perioperative care. This is an area that drove a large amount of the system s overall costs, says Betty Jo Rocchio, R.N. vice president of perioperative performance acceleration. Mercy standardized its perioperative supply choices in concert with surgeons on its staff and applied those choices across the organization, Rocchio says. In addition to saving money, outcomes have remained the same or improved, she says.

    The biggest task from a data perspective was getting it into an organized, actionable format so that people can make decisions and consume that information in a way that can drive their business, Rocchio says. Most of health care has a ton of data. It s the analytics that we struggle with.

    Emerging Issues: The Privacy of Medical Records

    Within the past two years, a substantial amount of attention has been paid to the issue of the privacy of patient records. The Health Insurance Portability and Accountability Act of 1996 required the Secretary of Health and Human Services to make recommendations to Congress on ways to protect the privacy of medical records. Secretary Shalala submitted her proposals to Congress on September 11, 1997. The National Academy of Sciences and the National Association of Insurance Commissioners have issued recommendations of their own. Senator Robert Bennett (R. – Utah) has circulated draft legislation entitled the “Medical Information Confidentiality Act” that may well be the focus of congressional action.

    Two developments account for this flurry of interest. The first is the growth of electronic medical record-keeping in place of paper records. The National Academy of Sciences report states that the health care industry spent between $10 and $15 billion on information technology in 1996. Much of this expenditure is attributable to creating electronic records systems and converting conventionally stored data to electronic formats.

    Electronic medical records (“EMRs”) appear to present new threats to maintaining the privacy of patient-identifiable medical records. An EMR can be called up instantaneously by someone with access to the data system and the relevant passwords. Although a paper record can be photocopied and faxed, it is less easy to distribute widely, and requires physical possession for accessibility. Computerized records systems are “black boxes” to many health professionals who are otherwise familiar with traditional records systems; they fear losing control of the systems and having to rely on computer experts who may not have internalized the privacy-related ethics of the medical profession. At the same time, one hears proposals to link all medical records systems so that patient data can be accessed wherever and whenever patients require medical services. This raises the prospect that access to one portion of one record may afford access to all records on an individual.

    The Managed Care Conflict

    A second reason for the increased concern over medical records privacy is the growth of managed care organizations. In the traditional, fee-for-service model of health care delivery, patient records would be produced and retained by the physician or other provider of services. The patient’s health insurer would be given access to selected records needed for claims review. Disclosure of the records required patient authorization, although, typically, patients executed these authorizations automatically and in blanket fashion. In a managed care organization, on the other hand, the provider of care and the insurer, in some sense, are the same entity. Any medical information in the possession of the provider also is held by the insurer. This is clearest in a closed-panel HMO like Kaiser but is present, to a varying degree, in all forms of managed care.

    The fear here is that the insurer will gain access to medical records that the patient and the provider would not normally transmit and that the insurer will use the data to take action adverse to the patient’s interest, such as limiting benefits or terminating the patient’s insurance coverage.

    Special problems are created by employer-sponsored health plans. Here, the plan is essentially the same entity as the employer and the concern is that the employer will have access to medical information possessed by the health plan and will use the information contrary to the employee’s interests, such as to terminate employment.

    The basic solutions that are being proposed are, first, to require record makers and keepers to implement a set of technical steps to protect the security of medical records and, second, to impose penalties on makers and keepers of records who release them for unauthorized or inappropriate purposes.

    Technical steps being touted include unique patient and access identifiers; “audit trails,” which are electronic methods of detecting and recording the identities of anyone who accesses a record; encryption of external transmissions of record information; appointment of internal information security officers with responsibility to police record-keeping practices; and “firewalls,” which are electronic barriers that isolate records systems from unauthorized access or penetration.

    The problem is that these techniques are expensive and no one is sure how well they work. I received a glimpse of how unrealistic these solutions might be at a meeting on medical records privacy I attended as a member of a joint working group of the Joint Commission on the Accreditation of Healthcare Organizations (“JCAHO”) and the National Committee for Quality Assurance (“NCQA”), the organization that accredits managed care organizations. One member of the working group, the person in charge of medical records at a large managed care plan, pointed out that neither she nor anyone else in her organization knew what records existed or where they were! She suspected that this was likely to be true of most managed care plans and provider organizations. Moreover, she explained that the greatest single threat to the privacy of medical records was post-it notes: people jotted down their passwords and pasted them on or near their computers. The more passwords, personal identifiers and other electronic steps a person had to take to access records, the more these little reminders would be necessary, rendering the fancy security techniques ineffective.

    Some of the other issues that are being debated by policy-makers include:

    • Whether to require patient enrollees to authorize each release of medical records or only to require them to give a blanket release, say upon enrollment. Advocates of blanket releases argue that requiring a signed authorization for every record release would be burdensome and most patients don’t care. Proponents of individual authorization respond that this is necessary to alert patients that their records are being disclosed so they can take steps to prevent inappropriate disclosures.
    • Whether to establish uniform standards or minimum standards. Managed care organizations and other record makers and keepers like uniform standards because it tells them clearly what they have to do. Some patient advocates propose minimum standards to enable plans to compete for enrollees on the basis of how well they maintain privacy: plans that adopted more stringent security measures could publicize this fact to potential enrollees who have a choice of plan.
    • Whether to enact a federal law that pre-empts stricter state laws. A uniform law would facilitate interstate business by allowing a managed care plan to comply with one standard nation-wide. But some patient advocates urge that states be allowed to adopt more stringent security requirements, if only to permit experimentation to see what works best at protecting privacy.
    • How much control to give patients over what goes in and what stays in their medical records. Most privacy proposals would give patients the right to correct inaccuracies in their records but not to delete material. Some patient advocates argue that patients should have the right to block the entry or remove information that they fear would stigmatize them or lead to insurance or employment discrimination. Health care professionals are concerned that incomplete records could interfere with proper medical management. Patient advocates respond that, so long as the incomplete records are marked as such, patients should be permitted to weigh the risks of stigma or discrimination against the risks of a reduced quality of care.

    There is almost certainly going to be federal legislation on medical record privacy. But this will not end the debate. Accreditation organizations such as the JCAHO and the NCQA will establish their own standards; managed care plans and provider organizations will adopt their own internal policies and procedures. Meanwhile, the science of electronic records and their security will develop, presenting new options and challenges. Stand by for further reports.

    Addiction is a term used often in our society. It seems as if every week there is some news story or discussion about a newly recognized addiction that is plaguing our society. Within the past few years, a whole variety of new addictions have been identified: video games, internet/computer usage, exercise, pornography, sex, food, and gambling are just some examples. However, despite how often it is discussed, most people do not have a true understanding of what addiction actually is.

    One of the main reasons for that is that addiction is not a diagnostic term. When someone seeks professional assistance for behavior they are concerned may constitute an addiction, the professional will do a thorough evaluation. After examining the behavior and what consequences are resulting from it, the diagnosis is made using the criteria outlined in the Diagnostic and Statistical Manual IV TR (2000) published by the American Psychological Association. That diagnosis is for abuse or dependence, not addiction.

    Essentially, addiction can be any behavior that one engages in compulsively, that an individual is unable to control despite a desire to do so, and that has caused negative consequences within one’s life. In the purest form of addiction, drug or alcohol use, it is easy to see the multiple aspects of the issue. Within the dependence category, one can have psychological dependence, physical dependence, or quite commonly, both.

    Research has now shown that addiction changes the brain. The brain’s production and usage of a variety of neurotransmitters is affected. The good news is that with most addiction, after enough time has passed without usage, the brain will begin to recover (this is NOT true if the individual is abusing inhalants). This is a huge advance in science, as for many years it was believed that the brain could not repair the damage done to it. Of course the longer and the more severe the usage, the longer it will take the brain to begin its recovery.

    The best recognized and most common treatment for addiction is the Alcoholics Anonymous (AA) model. AA was originally formed in 1937. While it has been widely successful, the understanding and treatment of addiction have come a long way. However, in examining the 12 Steps of AA, it is clear that a good base knowledge of addiction existed even back then.

    It is important to remember that addiction isn’t about weakness, moral failings, or being a bad person. No one sets out with the intention of becoming addicted. It is also not a matter of the individual having will power and just saying no. Addiction develops when people seeks to change their normal way of being the way they feel or think about things. As a result, treatment involves directly addressing these underlying issues and helping the individual to develop skills for coping with the situations in their life, rather than turning to something to numb it away.

    A new study by KLAS suggests that while providers are giving thought to business intelligence needs, they still haven t honed in on favored vendors that they see as holding a leading position in healthcare. That may be, I d suggest, because the industry is still waiting on EMRs that can offer the BI functionality they really need.

    To look at the issue of BI in healthcare, KLAS interviewed execs at more than 70 hospitals and delivery systems with 200 or more beds.

    When asked which BI vendors will stand out in the healthcare industry, 41 percent of respondents replied that they weren t sure, according to a story in Health Data Management .

    Of the other 59 percent who chose a vendor, IBM, SAP, Microsoft and Oracle came up as leaders in enterprise BI applications but none of the above got more than 12 percent of the vote, HDM notes.

    Vendors that did get a nod as standing out in healthcare-specific BI included Explorys, Health Catalyst, McKesson and Humedica (Optum). IBM and Microsoft were also singled out for healthcare use, but respondents noted that their products came with high price tags.

    Meanwhile, QlikTech and Tableau Software were noted for their usability and data visualization tools though lacking in full BI toolsets, according to HDM.

    While these stats are somewhat interesting on their own, they sidestep a very important issue: when will EMRs evolve from transaction-based to intelligence-based systems. After all, an intelligence-based EMR can do more to improve healthcare in context than freestanding BI systems.

    As my colleague John Lynn notes, EMRs will ultimately need to leverage big data and support smart processes, becoming what he likes to call the Smart EMR. These systems will integrate business intelligence natively rather than requiring a whole separate infrastructure to gather insights from the tsunami of patient data being generated today.

    The reality, unfortunately, is that we re a fairly long way away from having such Smart EMRs in place. Readers, how long to you think it will take before such a next-gen EMR hits the market? And who do you think will be the first to market with such a system?

    When Can You Claim a Tax Deduction for Health Insurance?

    Each year, June 28 marks National Insurance Awareness Day, serving as a reminder that it’s a good time to review your insurance coverage and ensure that it still fits your needs.

    This is particularly true for health insurance and making sure you have the right amount of coverage at an affordable cost.

    Health insurance can be expensive, so being able to claim a tax deduction for some of your insurance costs can help you save come tax time.

    Since there are specific rules and qualifications you must follow, here’s an overview of when you can and cannot claim a tax deduction on your health insurance.

    When health insurance is not tax-deductible

    If you didn’t pay for health insurance, you can’t take a tax deduction for it. If your employer pays your health insurance premiums, you can’t deduct those costs. However, if an employer only pays for part of your premiums, you still may be able to claim a tax deduction for the portion you paid.

    If you received a subsidy or premium tax credit to purchase an insurance plan in the Health Insurance Marketplace through the Affordable Care Act, any advanced-payment subsidy that lowered the cost of your health insurance premiums cannot be claimed as a tax deduction. However, the money you paid out of your own pocket for your premiums might be tax deductible.

    You can’t take a deduction for health insurance you paid for with pre-tax money. If you have insurance through your employer, the premiums you pay are usually taken out of your paycheck before your income taxes are calculated. Since these premiums are paid with pre-tax dollars, they’re already income-tax-free, meaning you can’t claim them as a tax deduction.

    Also note, you can not deduct health insurance unless you itemize your tax deductions or you are self-employed. You don t need to know if you qualify for itemized tax deductions, TurboTax will figure it out for you.

    When health insurance is tax-deductible

    If you’re self-employed, your health insurance premiums may be tax deductible. If you’re self-employed and not eligible for an employer-sponsored health plan through a spouse’s job, you may be eligible to write-off your health insurance premiums on your taxes. However, you can’t write off more in health insurance premiums than you earned.

    Health insurance premiums paid with your own after-tax dollars are tax deductible. For example, if you purchased health insurance on your own through a health insurance exchange or directly from an insurance company, the money you paid toward your monthly premiums can be taken as a tax deduction.

    Some Medicare plans are tax deductible. This includes Medicare Part B and Part D prescription coverage.

    There are limits to the amount of your health insurance you can deduct. If you are able to write-off your health insurance, there are limits to how much of your premiums you can write off.

    If you’re able to claim your health insurance as a medical expense deduction. you can only deduct medical expenses that exceed 10% of your adjusted gross income (7.5% if you’re 65 or older). If you’re self-employed and claimed the self-employed health insurance deduction, you don’t have to exceed the 10% threshold because you’re writing the premiums off as an adjustment to your self-employment income rather than as a tax deduction deduction.
