Payday Lenders (Deferred Presentment Providers)

A payday lender provides a short-term loan in exchange for a person’s check and a fee. The lender agrees to hold the check for a period of time before depositing it.

In Florida, the Florida Office of Financial Regulation’s Division of Consumer Finance regulates payday lenders. You can verify a license or file a complaint on the OFR website or call (850) Its Your Money (850-487-9687), if you have additional questions.

Consumers who take out a payday loan from a licensed lender are entitled to the following protections under Florida law:

  • A borrower may borrow up to $500 per loan.
  • A borrower may only have one outstanding loan at any time. This is tracked through a statewide database of all loans taken out.
  • The maximum fee is 10 percent of the amount borrowed plus a $5.00 verification fee.
  • The loan term cannot exceed 31 days or be less than 7 days.
  • Certain contract terms that limit a borrower’s rights are prohibited.
  • A borrower must pay a previous loan in full and wait 24 hours before entering into another loan. This period is designed to prevent loans from being rolled over into new loans and to give consumers the opportunity to consider other financial alternatives.
  • If at the end of the loan term, the borrower is unable to pay the loan in full, the loan provider must provide a 60-day grace period without additional charge. The grace period is dependent upon the borrower making an appointment with a Consumer Credit Counseling Service within 7 days and completing the counseling within the 60-day grace period.

Remember, Before You Take Out a Payday Loan:

  • Consider alternative solutions
    • Ask about delaying or making payment arrangements on your non-interest bills such as telephone and utility bills.
    • Talk to a friend or family member about borrowing money.
    • Ask your employer for an advance on your paycheck.
    • Set aside savings each month for future emergencies.
  • Verify a license on the OFR website or by calling (850) Its Your Money (850-487-9687), option 1.
  • Especially be careful to check the license if the payday lender is doing business online. Dealing with unlicensed Internet companies makes it difficult to resolve potential problems, and these companies may be located outside the United States.
  • Be wary of other short-term products that mimic payday loans, such as installment loans, open-ended lines of credit and auto title loans, which may use automated clearing houses or electronic transfer every two weeks.
  • Comparison shop for the lowest fees and penalties.
  • Borrow only what you can afford to pay back.
  • Know when your payment is due and be sure to repay the loan on time and in full.
  • Take advantage of local non-profit organizations across Florida that are available to help you with your financial situation. Many of these organizations offer help with budgeting, credit repair, debt repayment and more. Contact your local consumer credit counseling service, asset building coalition or United Way.
  • Set up a budget. Plan for the future by making a realistic budget to help avoid the need to borrow for emergencies and unforeseen expenses. Free budgeting worksheets are available on www.mymoney.gov.

The Cleveland Regional Loan Center (RLC) is one of eight VA regional loan centers (RLCs) administering VA s Home Loan Guaranty program, which helps Veterans obtain mortgage loans from private lenders by guaranteeing a portion of the loan against loss. In administering VA Home Loan Guaranty benefits, the RLC is the direct contact for the lending, appraising, and building communities and for Veterans with questions or concerns about their home loan benefit. The RLC trains and oversees the program s private-sector stakeholders and conducts outreach to the housing and Veteran communities. RLC staff also work with loan servicers to help Veterans avoid foreclosure and assist service-disabled Veterans with applying for VA s Specially Adapted Housing benefit.

    1. Complete New MPN for Student Loans (student ONLY applying for Subsidized, Unsubsidized, or GRAD PLUS Loan)
    2. Complete New MPN for Parent PLUS Loans. IMPORTANT NOTE: You and your parent must both sign the Promissory Note with your U.S. Department of Education issued PIN numbers.
  4. Follow the step by step instructions and be sure to choose “Mercer University Main Campus” as the Institution of record.
  5. Print your completed Master Promissory Note borrower copy to keep for your records.

Your loan cannot be finalized until this requirement has been fulfilled. If, for some reason, you need to sign a paper promissory note, we can provide one upon request. However, please be aware that this may delay receipt of your funds.

Federal Direct Stafford Loan

Ford Direct Loan Program, administered by the US Department of Education.  Direct student loans are low interest loans to help pay for the cost of a student’s education after high school.  William D. Ford loan funds are borrowed directly from the federal government, not from banks.

How to Consolidate Loans

About how an approved agency pays off your existing loans and creates a single new loan.

The basics

Consolidation is the process by which an approved agency pays off your existing loans and creates a single new loan. In essence, you refinance your education debts.

After you graduate or are no longer enrolled at least half-time. you may want to consider consolidating your loans to avoid multiple monthly payments. However, consolidation is not always the best option, as you may lose deferment privileges, and federal death and disability benefits, while paying back more in interest over time.

Advantages

Typically there are no prepayment penalties.

Federal consolidation loans do not have fees .

A reduced monthly payment with an extended loan term.

Fewer bills to manage various repayment options:

  • Standard repayment—you pay a fixed amount each month until your loan is paid in full.
  • Extended repayment—allows you to extend loan repayment over a period of 10 to 30 years, depending on your loan amount.
  • Graduated repayment—allows you to make smaller payments at first, and larger payments later. This is a good strategy for students who cannot make large payments immediately after graduation. Payments start low and increase every few years.
  • Income contingent repayment—your monthly payment is based on your yearly income, family size, and loan amount. Your payments rise and fall with your income. After 25 years, any remaining balance on the loan is forgiven, however, you may have to pay taxes on the amount forgiven. Payments may never exceed 20 percent of your discretionary income.
  • New Income-Based Repaymen t is now available—your monthly payment is based on your annual income. You must have a partial financial hardship to enroll.

Disadvantages

You may lose deferment options.

More interest over time if you choose not to prepay your loan.

Possible loss of payback benefits from current lenders (i.e. interest rate reductions for submitting on-time payments).

To consolidate federal student loans

Consolidation is available to most borrowers of federally funded educational loans. A new Special Direct Consolidation Loan has been made available.

To qualify for federal loan consolidation, borrowers must:

  • Be in their grace period OR currently repaying their educational loans
  • Not be more than 90 days delinquent on educational loan payments

You may also want to contact your lender or servicer to discuss other repayment options. If you do not know your lender(s), access your federal loan information through the National Student Loan Data System (NSLDS) .

To consolidate private alternative student loans

Most lenders do not consolidate private loans together with federal loans. Review the terms and conditions associated with each loan program before you apply. Alternative lenders may require you to be in active repayment before you can apply. You may want to contact your private alternative lender, if not listed, to find out if they offer a consolidation loan.
