Wal-Mart says adding semantic search has improved online shoppers completing a purchase by 10% to 15%. In Wal-Mart terms, that is billions of dollars, Laney said.

4.Fast foodand video. This company (Laney wasn’t giving up who) is training cameras on drive-through lanes to determine what to display on its digital menu board. When the lines are longer, the menu features products that can be served up quickly; when the lines are shorter, the menu features higher-margin items that take longer to prepare.

5. Morton’s The Steakhouseand brand recognition. When a customer jokingly tweeted the Chicago-based steakhouse chain and requested that dinner be sent to the Newark airport, where he would be getting in late after a long day of work, Morton’s became a player in a social media stunt heard ’round the Interwebs. The steakhouse saw the tweet, discovered he was a frequent customer (and frequent tweeter), pulled data on what he typically ordered, figured out which flight he was on, and then sent a tuxedo-clad delivery person to serve him his dinner. Sure, the whole thing was a publicity stunt (that went viral), but that’s not the point. The question businesses should be asking themselves: Is your company even capable of something like this? Laney said.

6.PredPol Inc.and repurposing. The Los Angeles and Santa Cruz police departments. a team of educators and a company called PredPol have taken an algorithm used to predict earthquakes, tweaked it and started feeding it crime data. The software can predict where crimes are likely to occur down to 500 square feet. In LA, there’s been a 33% reduction in burglaries and 21% reduction in violent crimes in areas where the software is being used.

7. Tesco PLCand performance efficiency. The supermarket chain collected 70 million refrigerator-related data points coming off its units and fed them into a dedicated data warehouse. Those data points were analyzed to keep better tabs on performance, gauge when the machines might need to be serviced and do more proactive maintenance to cut down on energy costs.

Express Scripts, which processes pharmaceutical claims, realized that those who most need to take their medications were also those most likely to forget to take their medications. 10. InfinityProperty Casualty Corp. anddark data . Laney defines dark data as underutilized information assets that have been collected for single purpose and then archived. But given the right circumstances, that data can be mined for other reasons. Infinity, for example, realized it had years of adjusters’ reports that could be analyzed and correlated to instances of fraud. It built an algorithm out of that project and used the data to reap $12 million in subrogation recoveries.

Essential Information

Our Corporate Communications and Public Relations degree provides the relevant skills and knowledge required for a career within PR and Public Affairs.

Full-time Study
In full time mode, you will learn through a combination of lectures, seminars and workshop sessions. These comprise of a mix of group study, discussion, simulation and presentations of findings by teams and individuals. You will work as an individual and also as part of a team on case studies, team activities, presentations and discussions.

Part-time Study
Our part-time delivery mode combines aspects of distance learning and on-campus delivery. You will benefit from the support of the virtual learning environment but also face-to-face interaction with tutors and classmates.

Our supported distance learning mode of delivery allows you to study online from any location and is designed to fit in around your work commitments. You will be taught and supported by experienced industry professionals who will recreate the same challenging interactive format of the on-campus courses for those studying at a distance.

4. Entry requirements

  • Applicants normally hold a 2:2 undergraduate honours degree or its equivalent in any subject area.
  • Applicants with a lower degree classification and / or relevant work experience will be considered on a case by case basis.

English Language

Applicants whose first language is not English should have an IELTS of 6.5 overall, with no component lower than 5.5, or an equivalent.

5. Placements and accreditations

A four-week work placement within a Communication, Media or Marketing environment is undertaken as part of the course. Companies offering placements expect students to be creative and to come on placement with energy, enthusiasm and some creative new’ ideas. Students often produce work that they are then able to put into a personal portfolio.

Previous students have elected to pursue roles within blue-chip corporations; global communications consultancies; global broadcasting companies; newspapers; leading arts and heritage organisations; oil and gas industry; marketing agencies; public sector; charities; digital media; and TV and radio.

Depending on the placement, you will work on small individual or team projects. You will also be given the chance to observe the overall running of the company, learn about different communication strategies and experience why companies adopt the strategies they do.

The masters degree qualification of this course* has been awarded accreditation and is approved by the Chartered Institute of Public Relations (CIPR) and students are eligible for student membership. Recognition by the professional body is an assurance of the high professional standard and credibility of this corporate communication course.

Emerging Issues: The Privacy of Medical Records

Within the past two years, a substantial amount of attention has been paid to the issue of the privacy of patient records. The Health Insurance Portability and Accountability Act of 1996 required the Secretary of Health and Human Services to make recommendations to Congress on ways to protect the privacy of medical records. Secretary Shalala submitted her proposals to Congress on September 11, 1997. The National Academy of Sciences and the National Association of Insurance Commissioners have issued recommendations of their own. Senator Robert Bennett (R. – Utah) has circulated draft legislation entitled the “Medical Information Confidentiality Act” that may well be the focus of congressional action.

Two developments account for this flurry of interest. The first is the growth of electronic medical record-keeping in place of paper records. The National Academy of Sciences report states that the health care industry spent between $10 and $15 billion on information technology in 1996. Much of this expenditure is attributable to creating electronic records systems and converting conventionally stored data to electronic formats.

Electronic medical records (“EMRs”) appear to present new threats to maintaining the privacy of patient-identifiable medical records. An EMR can be called up instantaneously by someone with access to the data system and the relevant passwords. Although a paper record can be photocopied and faxed, it is less easy to distribute widely, and requires physical possession for accessibility. Computerized records systems are “black boxes” to many health professionals who are otherwise familiar with traditional records systems; they fear losing control of the systems and having to rely on computer experts who may not have internalized the privacy-related ethics of the medical profession. At the same time, one hears proposals to link all medical records systems so that patient data can be accessed wherever and whenever patients require medical services. This raises the prospect that access to one portion of one record may afford access to all records on an individual.

The Managed Care Conflict

A second reason for the increased concern over medical records privacy is the growth of managed care organizations. In the traditional, fee-for-service model of health care delivery, patient records would be produced and retained by the physician or other provider of services. The patient’s health insurer would be given access to selected records needed for claims review. Disclosure of the records required patient authorization, although, typically, patients executed these authorizations automatically and in blanket fashion. In a managed care organization, on the other hand, the provider of care and the insurer, in some sense, are the same entity. Any medical information in the possession of the provider also is held by the insurer. This is clearest in a closed-panel HMO like Kaiser but is present, to a varying degree, in all forms of managed care.

The fear here is that the insurer will gain access to medical records that the patient and the provider would not normally transmit and that the insurer will use the data to take action adverse to the patient’s interest, such as limiting benefits or terminating the patient’s insurance coverage.

Special problems are created by employer-sponsored health plans. Here, the plan is essentially the same entity as the employer and the concern is that the employer will have access to medical information possessed by the health plan and will use the information contrary to the employee’s interests, such as to terminate employment.

The basic solutions that are being proposed are, first, to require record makers and keepers to implement a set of technical steps to protect the security of medical records and, second, to impose penalties on makers and keepers of records who release them for unauthorized or inappropriate purposes.

Technical steps being touted include unique patient and access identifiers; “audit trails,” which are electronic methods of detecting and recording the identities of anyone who accesses a record; encryption of external transmissions of record information; appointment of internal information security officers with responsibility to police record-keeping practices; and “firewalls,” which are electronic barriers that isolate records systems from unauthorized access or penetration.

The problem is that these techniques are expensive and no one is sure how well they work. I received a glimpse of how unrealistic these solutions might be at a meeting on medical records privacy I attended as a member of a joint working group of the Joint Commission on the Accreditation of Healthcare Organizations (“JCAHO”) and the National Committee for Quality Assurance (“NCQA”), the organization that accredits managed care organizations. One member of the working group, the person in charge of medical records at a large managed care plan, pointed out that neither she nor anyone else in her organization knew what records existed or where they were! She suspected that this was likely to be true of most managed care plans and provider organizations. Moreover, she explained that the greatest single threat to the privacy of medical records was post-it notes: people jotted down their passwords and pasted them on or near their computers. The more passwords, personal identifiers and other electronic steps a person had to take to access records, the more these little reminders would be necessary, rendering the fancy security techniques ineffective.

Some of the other issues that are being debated by policy-makers include:

  • Whether to require patient enrollees to authorize each release of medical records or only to require them to give a blanket release, say upon enrollment. Advocates of blanket releases argue that requiring a signed authorization for every record release would be burdensome and most patients don’t care. Proponents of individual authorization respond that this is necessary to alert patients that their records are being disclosed so they can take steps to prevent inappropriate disclosures.
  • Whether to establish uniform standards or minimum standards. Managed care organizations and other record makers and keepers like uniform standards because it tells them clearly what they have to do. Some patient advocates propose minimum standards to enable plans to compete for enrollees on the basis of how well they maintain privacy: plans that adopted more stringent security measures could publicize this fact to potential enrollees who have a choice of plan.
  • Whether to enact a federal law that pre-empts stricter state laws. A uniform law would facilitate interstate business by allowing a managed care plan to comply with one standard nation-wide. But some patient advocates urge that states be allowed to adopt more stringent security requirements, if only to permit experimentation to see what works best at protecting privacy.
  • How much control to give patients over what goes in and what stays in their medical records. Most privacy proposals would give patients the right to correct inaccuracies in their records but not to delete material. Some patient advocates argue that patients should have the right to block the entry or remove information that they fear would stigmatize them or lead to insurance or employment discrimination. Health care professionals are concerned that incomplete records could interfere with proper medical management. Patient advocates respond that, so long as the incomplete records are marked as such, patients should be permitted to weigh the risks of stigma or discrimination against the risks of a reduced quality of care.

There is almost certainly going to be federal legislation on medical record privacy. But this will not end the debate. Accreditation organizations such as the JCAHO and the NCQA will establish their own standards; managed care plans and provider organizations will adopt their own internal policies and procedures. Meanwhile, the science of electronic records and their security will develop, presenting new options and challenges. Stand by for further reports.

Should You Bank Your Baby’s Cord Blood?

There are so many things to think about when you have a child. One of them is the blood from your baby’s umbilical cord (which connects the baby to the mother while in the womb). It used to be thrown away at birth, but now, many parents store the blood for the future health of their child. Should you do it?

What Can It Be Used For?

The umbilical cord fluid is loaded with stem cells. They can treat cancer. blood diseases like anemia. and some immune system disorders. which disrupt your body’s ability to defend itself.

The fluid is easy to collect and has 10 times more stem cells than those collected from bone marrow.

Stem cells from cord blood rarely carry any infectious diseases and are half as likely to be rejected as adult stem cells.

How Do You Get It?

If you want the blood stored, after the birth, the doctor clamps the umbilical cord in two places, about 10 inches apart, and cuts the cord, separating mother from baby. Then she inserts a needle and collects at least 40 milliliters of blood from the cord. The blood is sealed in a bag and sent to a lab or cord blood bank for testing and storage. The process only takes a few minutes and is painless for mother and baby .

The cord blood bank may also send tubes so that the mother’s blood can be taken, too. If so, the banking kit will have instructions along with blood collection tubes.

Where Is It stored?

There are three options:

Public cord banks don’t charge anything for storage. Any donation made is available for anyone who needs it. The bank may also use the donated cord blood for research.

Private (commercial) cord banks will store the donated blood for use by the donor and family members only. They can be expensive. These banks charge a fee for processing and an annual fee for storage.

Direct-donation banks are a combination of public and private banks. They store cord blood for public use. But they also accept donations reserved for families. No fee is charged.

Should You Bank Your Baby’s Cord Blood?

It depends on who you ask. Although commercial cord blood banks often bill their services as “biological insurance” against future diseases, the blood doesn’t often get used. One study says the chance that a child will use their cord blood over their lifetime is between 1 in 400 and 1 in 200,000.

The stored blood can’t always be used, even if the person develops a disease later on, because if the disease was caused by a genetic mutation, it would also be in the stem cells. Current research says the stored blood may only be useful for 15 years.

The American Congress of Obstetricians and Gynecologists and the American Academy of Pediatrics don’t recommend routine cord blood storage. The groups say private banks should only be used when there’s a sibling with a medical condition who could benefit from the stem cells. Families are encouraged to donate stem cells to a public bank to help others.

If you do decide to bank your baby’s cord blood, there’s one more thing to keep in mind: It’s best not to make it a last-minute decision. You should coordinate with the bank before your baby is born so nothing is left to chance.

Insurance Adjusters: Who They Are and How They Handle an Injury Claim

Insurance claims adjusters come with different titles, such as claims specialist, claims representative, or independent claims analyst, but they all do the same job. Understanding who claims adjusters are and how they work to resolve an injury-related insurance claim lets you see that they have no real advantage over you in the negotiation process. Indeed, by having a good understanding of the facts of your own claim, you may well have an advantage over them.

The Role of the Insurance Adjuster

When you have filed a claim against someone you believe was responsible for your accident, normally the negotiation process will be with a claims adjuster for that person s liability insurance company.

Occasionally, a claim is not handled by an insurance company s own adjuster, but instead is referred to a firm of independent insurance adjusters. Insurance companies often do this if they do not have a local claims office in a particular area.

Independent claims adjusters representing an insurance company operate the same as in-house claims adjusters. The only difference is that they may have a lower authority limit within which to settle a case and therefore must have your settlement amount approved by a claims supervisor at an insurance company office. The negotiation process, however, is exactly the same.

Public entities such as state governments or large cities that receive lots of claims often have their own claims adjustment offices. The negotiation process with these government claims adjusters works the same as with private insurance adjusters. The only notable difference in negotiating with a government claims adjuster is that if a claim eventually winds up in court, judges and juries tend not to be overly generous in awarding damages with public money. For this reason, government entity adjusters tend to be tighter with settlement money than private insurance adjusters. If you have a claim against a public entity, expect your settlement to be 10% to 25% lower than if it were against a private party.

It sometimes happens that even though you have not filed a lawsuit, you find an attorney — instead of a claims adjuster — negotiating with you about your claim. Self-insured corporations and some insurance companies without a local claims office sometimes use either their own staff attorney or a local attorney as a claims adjuster. And government entities sometimes have assistant city, county, or state attorneys who deal directly with accident claims even before they get to court.

If an attorney is handling your claim instead of a claims adjuster, don t panic. In the claims negotiation process, a lawyer cannot do anything different from a non-attorney claims adjuster. A lawyer may bluff a little more than a claims adjuster about the law regarding negligence and liability, but there are easy techniques to call that kind of bluff.

If you file a claim under your own automobile collision, uninsured, or underinsured motorist coverage, you do not negotiate a settlement with your own insurance agent. All an agent can do is refer your claim to the claims department — and then it is completely out of the agent s hands. You will then negotiate an injury settlement with a claims adjuster who will be acting as the company s representative, not yours.

How Adjusters Settle Claims

The job performance of insurance adjusters is judged not only by how little of the insurance company s money they spend in settlements but also by how quickly they settle claims. Most adjusters get between 50 and 100 new claims a month across their desks. They have to settle that many claims — known as clearing or closing a claim file — each month just to stay even. Their performance is also rated on how many claims they can personally settle without having to involve supervisors or insurance company lawyers. Once an adjuster knows that you understand the range of how much your claim is worth, the adjuster will not usually stall your claim.

During negotiations, you will find that you know much more about your claim than the adjuster does. Except for those assigned to the largest cases, insurance claims adjusters have no special legal or medical training. And most have neither the time nor the resources to investigate or study your claim very carefully.

The result is that while an adjuster will know more than you about the claims business in general, he or she will not know your particular claim nearly as well as you do. You were there during the accident. You know what your injuries are, how much and where they hurt, and how long they have taken to heal. You have put in the time to understand how the accident happened and to demonstrate through photos and medical records and other documents what your damages were. The insurance adjuster, on the other hand, has only a couple of minutes a week to look at your file. As long as you are organized and understand the process, you are the one with the negotiating advantage.

The adjuster has the authority to come to an agreement with you on the telephone for what the final settlement amount should be. Once you and the adjuster agree on an amount, the adjuster simply sends you the paperwork to finalize the settlement. But adjusters authority to settle claims on their own is restricted to certain dollar limits. The limits depend on how much experience the adjuster has. For less experienced adjusters, the limit is between $5,000 and $10,000. For more experienced adjusters, the limit is between $10,000 and $20,000.

An adjuster will not disclose the limits of the adjuster s authority is unless you re going to get an offer higher than that authority. If so, the adjuster will have to ask for approval from a superior usually called a claims supervisor or claims manager. This is neither unusual nor difficult. But if the adjuster does need to check with a supervisor about your settlement offer, get a date by which you will hear back from either one, and then send a letter to the adjuster confirming that date.

Global Health

The School of Public Health offers a Specialty Area of study in Global Health for graduate students enrolled in any of the School’s discipline-based programs. The objectives of the Global Health Specialty Area (GHSA) are to support and cultivate students’ interests in global health, and to help develop competencies and skills in global public health that can be applied to students’ careers. The GHSA provides an opportunity for students to explore multidisciplinary issues in global health through coursework, mentorship, and global health engagement.

Eligibility

Graduate students enrolled in a discipline-based program at the School of Public Health and Master of Development Practice (MDP) program.

Requirements

  • Initial advising session: Email and meet with Robert Snyder to schedule a meeting to:
    • Discuss your interests and goals in global health
    • Go through your advising and tracking form (found in the GHSA handbook )
    • Choose three potential faculty mentors from the mentor list (found in the GHSA handbook )
    • Address other matters of concern (i.e. internships, course selection, GHSA requirements, etc.)
  • Global Health faculty mentor: More than 30 faculty members at UC Berkeley are designated mentors in the GHSA (see GHSA handbook ). Each mentor brings a different set of skills, geographic expertise, and research areas. You will be assigned a mentor after your initial advising session. We will try our best to match you with one of your top choices. These mentors do not need to be your only global health mentors. GHSA core advisors are always available, and we encourage students to connect with other faculty who are not their mentors.

2. Global Health Coursework (9 units total)

  • Complete at least one global health core course (2 units).
    • Fall: Foundations of Global Public Health: PH C253/DEVP C232 (Reingold/Fong) – 2 units
    • Spring: The Future of Global Public Health: PH 212D (Hemmerling/Le) – 2 units
    • We encourage students to take both courses, and most take the course during Year 1. Those without previous global health experience are highly recommended to take the fall course.
  • Complete a minimum of 5 additional units of global health coursework (7, if only one core course).
    • Coursework should enable students to gain a transdisciplinary global health perspective.
    • Eligible courses are chosen from a list of those approved by GHSA staff at the School of Public Health, and in other UC Berkeley departments. A list of approved courses is included in the GHSA handbook. Other courses can qualify if approved in consultation with GHSA advisors and/or your faculty mentor.
    • These additional courses cannot be core requirements for your degree program. A GHSA core advisor can assess these on a case-by-case basis.
    • Courses must be taken for a letter grade.
  • In addition, you must meet all course requirements and electives for your degree program.

3. Global Health Engagement

  • Events: This concentration also aims to bring together the UC Berkeley global health community. As such, we request all those in the GHSA to attend two global health seminars or events at UC Berkeley each semester (i.e. events hosted by the School of Public Health. Center for Emerging and Neglected Diseases. Center for Global Public Health. Blum Center. Bixby Center. etc.). We will inform you about Bay Area global health events, news, and opportunities.
  • Internships: (Note: Global health internships are recommended, but not required. It is a desired outcome of the specialty, but is not mandatory.)
    • For students in 2-year programs, we encourage you to work with your mentor to develop a global health-related internship in the summer, either at home or abroad. While the responsibility for securing an acceptable international placement lies with the student, the Center for Public Health Practice Leadership (CPHPL) and the Center for Global Public Health (CGPH) offer a number of resources for global health internships. MPH internship placements must be approved by the CPHPL and should provide the student with a relevant and rigorous off-campus learning experience.
    • Students in 1-year programs are encouraged to seek practical and/or research experiences in global health during their studies. Your mentor can help you brainstorm, and you are welcome to contact CPHPL and CGPH to explore opportunities.
  • Graduate Global Health Connection: Starting in the fall semester 2016, the CGPH-SPH will be sponsoring monthly semi-structured meetups on the last Monday or Tuesday of each month. These events are organized in an effort to develop a global health community at Berkeley and also to facilitate networking and global health career development activities among our graduate students. The meetings are mandatory (minimum requirement: 2 of 4 per semester) for all those interested in (or already pursuing/in) the GHSA and the CGPH Fellows programs.

Accreditation

Each student who successfully completes the requirements of the GHSA will receive a document signed by the Chair of the Global Health Specialty Area (Professor Art Reingold) certifying the student’s completion of the requirements for the specialty area.

What s So Bad About Casual Drug Use?

So Representative Trey Radel, the Republican from Florida, a self-styled “conservative voice ” in Congress, has pleaded guilty to a misdemeanor charge of cocaine possession. And Toronto’s city council has stripped Mayor Rob Ford of much of his power after it came out that he had smoked crack (never mind that Ford’s well-known drunken antics were not cause for such censure).

Rather than arguing whether such figures are hypocrites (Radel voted in favor of mandatory drug testing for food-stamp beneficiaries) or debating how they should attempt damage control (he’s also pledged to enter a substance-abuse program after paying a fine and receiving a year’s probation), let’s ask a more basic question: What’s so scandalous about casual drug use?

Yes, some substances are illegal (though as the case of marijuana shows, this status is subject to change). But absent other indicators of dangerous and antisocial behavior — like driving while intoxicated — why should snorting coke be treated any differently than, say, drinking a beer?

Prohibitionists typically deny the very possibility of responsible or voluntary use of currently illegal substances. They argue that drugs such as coke, heroin, ecstasy, methamphetamine and even marijuana are verboten precisely because they simply can’t be used casually. Any use either already constitutes abuse or quickly leads to it. “Drugs are not dangerous because they are illegal,” former drug czar William Bennett and former Health, Education and Welfare Secretary Joseph Califano wrote in a 2011 Wall Street Journal op-ed, “they are illegal because they are dangerous.”

Nearly 50% of people have tried an illegal drug at least once, yet most don’t repeat the experience. With cocaine, most who have tried it not only don’t go on to became addicts under even the most expansive possible definition of the term, they don’t even go on to become regular users.

According to the latest National Survey on Drug Use and Health. 14.5% of Americans ages 12 and older have tried cocaine at least once, but just 1.8% report using the drug recreationally in the past year. And just 0.6% have used it in the past 30 days, which would seem to be the minimal definition of a casual user.

The same pattern is true for heroin, which is typically talked about as magically addictive. Fear of the drug is surely one of the reasons why just 1.8% of Americans have ever tried it at all. But only 0.3% report using it in the past year and just 0.1% in the past month. That pattern simply shouldn’t be possible if these drugs were as addictive as commonly thought.

In the early 1970s, researcher Lee N. Robins led a study commissioned by the Department of Defense that followed tens of thousands of Vietnam War veterans as they returned to the U.S. Use of narcotics and heroin was rampant among soldiers stationed in Southeast Asia, with as many 20% showing signs of addiction. Yet during the first year back, “only 5% of those who had been addicted in Vietnam were addicted in the U.S.” and “at three years, only 12% of those addicted in Vietnam had been addicted at any time in the three years since return, and for those readdicted, the addiction had usually been very brief.” It wasn’t for lack of access to junk, either: half of the returning addicts said they’d tried heroin at least once since arriving back home.

As my Reason colleague Jacob Sullum has documented, such take-it-or-leave-it findings are common in drug research. In his 2004 book Saying Yes and other places, he’s detailed work in which researchers find a surprising range among heroin users, including a study that concluded. “It seems possible for young people from a number of different backgrounds, family patterns and educational abilities to use heroin occasionally without becoming addicted.

It’s also true that regular drug users can often function quite well. Sigmund Freud used cocaine habitually for years, and his first major scientific publication was about the wonders of the drug (he eventually forsook it). Another pioneering late 19th and early 20th century man of medicine, William Halsted, was dependent on cocaine and morphine during an illustrious career that revolutionized and modernized surgical techniques.

None of this is a brief for snorting cocaine, shooting heroin or smoking marijuana (a substance that 58% of Americans think should be legal for recreational use) any more than it is a plea for drinking single-malt whiskey or pinot noir.

But in an age in which we are expected to use legal drugs (like beer) and prescription medications (Adderall) responsibly, it’s time to extend that same notion to currently illegal substances whose effects and properties are widely misunderstood. Indeed, the effects of coke, heroin and the rest are a mystery partly because their outlaw status makes it difficult both to research them and have honest discussions about them.

Radel has announced that he’ll be taking a leave of absence from Congress while he enters rehab. Perhaps he does need to sober up — that’s really for him and his family to decide — but it’s far from clear that his problem is particular to cocaine or illegal drugs. Indeed, in announcing his plans, he didn’t blame cocaine for his troubles but “the disease of alcoholism ,” which he says led him to make really bad decisions. And alcohol, after all, is perfectly legal.

Your child needs to have a current sports physical completed and on file with the school nurse in order to participate on the DEPAOLO sports teams. All athletes also need to have an emergency medical form filled out for the nurse as well. Both of these forms are to be brought to the school nurse and your child will be given a yellow card verifying to the coach that the athlete is cleared by the nurse to tryout for fall sports. New this year is a concussion form that is MANDATORY to be signed at your parent meeting with your coach.

Master of Public Policy (MPP)

Unlike other degree programs that cover a range of policy areas, the Heller School MPP focuses specifically on domestic social policy. This allows our students to dig into the social issues they’re most passionate about, because we believe that if you want to create systemic change, you need to think beyond the status quo.

The Heller MPP is a two-year program to develop the skill set that every policy analyst and social change agent needs to be successful. It starts by learning how to conduct sophisticated structural analysis. Students can choose to study in a specific social policy concentration, such as poverty alleviation or behavioral health, and everyone gains experience on the ground through funded internships.

We are a small community that s cooperative, not competitive. Our students, faculty and alumni have diverse social policy interests, but we all realize policy s potential to advance social justice change both locally and nationally. Heller MPP graduates get policy jobs around the United States, with one-third working in Boston, one-third in Washington, D.C. and the final third spread around the country.

The Crime Records Service Legal Staff provides support to the bureaus of Crime Records Service and the numerous divisions of the Department. The legal staff responsibilities generally relate to the expunction of criminal history record information, restricted access and sealing of juvenile records, and statutory access to criminal history record information.

Expunction of criminal history record information

Expunctions
Chapter 55 of the Texas Code of Criminal Procedure contains provisions for the expunction of arrest records, court records and criminal history record information. The statute specifically details the requirements and procedures to properly expunge records in Texas.

Since the Department may oppose a petition for expunction, the CRS Legal Staff cannot assist individuals in the expunction of records. All individuals seeking an expunction of records are encouraged to obtain a copy of their criminal history maintained by the Department (PDF) and to seek the advice of a licensed attorney to determine if they are eligible for the expunction of records.

Orders of Nondisclosure
Texas Government Code Section 411.071 allows an individual who has successfully completed deferred adjudication community supervision to petition the court that placed the individual on probation for an order of nondisclosure. An order of nondisclosure prohibits criminal justice agencies from disclosing to the public criminal history record information related to an offense.

Criminal history record information subject to an order of nondisclosure is excepted from required disclosure under the Public Information Act. Criminal justice agencies are permitted to release criminal history record information subject to an order of nondisclosure to criminal justice agencies, authorized noncriminal justice agencies and the individual who is the subject of the criminal history record information.

The CRS Legal Staff cannot assist individuals in petitioning the court for an order of nondisclosure. Individuals seeking an order of nondisclosure should seek the advice of a licensed attorney to determine if they are eligible for an order of nondisclosure.

Sealing of Juvenile Records
Family Code Section 58.003 provides for the sealing of juvenile records. The new process described as “automatic sealing,” eliminates the requirements to file an application or petition to seal records and mandates the juvenile court to order sealing of records if the juvenile meets statutory criteria. The Department of Public Safety (DPS) is notifying the juvenile probation department when a juvenile record maintained by DPS may be eligible for automatic sealing.

Automatic Restriction of Access to Juvenile Records
Family Code Section 58.203 restricts access to certain juvenile records. Records relating to an individual’s juvenile case that meet the criteria established by 58.203 are certified by the Department for automatic restriction

Upon certification, the department may not disclose the existence of the records or any information from the records in response to an inquiry from:

  • a law enforcement agency;
  • a criminal or juvenile justice agency;
  • a governmental or other agency given access to information under Chapter 411, Government Code; or
  • any other person, agency, organization, or entity.

The department may permit access to:

  • a criminal justice agency for a criminal justice purpose; or
  • for purposes, by the Texas Juvenile Justice Department.

Misuse Of Identity
The misuse or theft of a person s identity may occur in several ways. If your identity has been misused by another to secure credit, open a checking account or make purchases in your name, please follow this link: Identity Theft Information Guide

The following procedures are available if your name or identifying information was falsely given by an arrested individual as their identifying information.

  • Chapter 55 of the Texas Code of Criminal Procedure contains provisions for a person to expunge their identifying information, including name, address, date of birth, driver s license number and social security number, falsely presented by an arrested person as the arrested person s identifying information. The person seeking the expunction should contact the district attorney in the county in which the person lives and file an application for expunction.
  • Individual Identity File: Government Code 411.0421 allows a person to file a declaration with the sheriff of the county in which they reside stating the person s identity was used by another to frustrate proper law enforcement without their consent. Upon receipt of a declaration from the sheriff, the Department of Public Safety will create a record of the misused identity along with a unique password to be used by the person to verify their identity to law enforcement. For more information concerning this procedure, contact the sheriff in your county of residence.

Applications for admission to the Rutgers School of Public Health are encouraged from qualified college graduates with a Baccalaureate degree who desire training in the disciplines of public health and who have realistic plans for utilizing what they learn. Most students are admitted in matriculated status in the MPH, MS, or PhD degree programs. Applicants are accepted to a specific department on a specific campus. A smaller number, often those not meeting all of the admission criteria, are admitted in non-matriculated status. These students normally are permitted to take up to 12 credits of coursework and, if they achieve a cumulative grade point average of 3.0 or better, to matriculate in the MPH program. The School also accepts visiting students and certificate students for limited amounts of coursework. Upon receipt of an acceptance letter, students are required to send a non-refundable $100.00 seat deposit to the campus that they will be attending, which is applied to the first tuition bill when the student registers. The check is payable to Rutgers School of Public Health.

Application is administered through the Schools of Public Health Application Service (SOPHAS) except for students in a dual degree, residency, or fellowship program, as well as those having Rutgers faculty status, and students applying to a certificate program or seeking non-matriculated status. Federal Identity Theft Laws

Legislative efforts to create federal identity theft laws must balance the competing needs of victims, government agencies, and businesses, yet stay flexible enough to anticipate future identity crime issues.

Prior to 1998, crimes that would now be considered identity theft were charged under false personation statutes, which go back to the late 19th century. False personation can be defined as the crime of falsely assuming the identity of another to gain a benefit or avoid an expense.

It wasn t until Congress passed the Identity Theft and Assumption Deterrence Act of 1998 that identity theft was officially listed as a federal crime. The act strengthened the criminal laws governing identity theft. Specifically, it amended 18 U.S.C. § 1028 ( Fraud and related activity in connection with identification documents ) to make it a federal crime to

knowingly transfer or use, without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State or local law. The Identity Theft and Assumption Deterrence Act accomplished four things:

  • It made identity theft a separate crime against the individual whose identity was stolen and credit destroyed. Previously, victims had been defined solely by financial loss and often the emphasis was on banks and other financial institutions, rather than on individuals.
  • It established the Federal Trade Commission (FTC) as the Federal Government s one central point of contact for reporting instances of identity theft by creating the Identity Theft Data Clearinghouse.
  • It increased criminal penalties for identity theft and fraud. Specifically, the crime now carries a maximum penalty of 15 years imprisonment and substantial fines.
  • It closed legal loopholes, which previously had made it a crime to produce or possess false identity documents, but not to steal another personal s personal identifying information.
  • Over time, state legislative bodies also started to pass laws that helped victims, and these laws ended up being the basis for many national laws years later. As most crimes are prosecuted on the state level, these laws came to have a significant positive impact on victims.

    Other federal laws have been enacted to address the growing complexities surrounding identity theft and fraud. These include the following:

    Fair Debt Collection Practices Act (FDCPA)
    The Fair Debt Collection Practices Act (15 U.S.C. §§ 1692-1692p, as amended by Pub. L. 109-351, §§ 801-02, 120 Stat. 1966) prohibits debt collectors from using unfair or deceptive practices to collect overdue bills that a creditor has forwarded for collection.

    Fair Credit Reporting Act (FCRA) and the Fair and Accurate Credit Transactions Act (FACTA) of 2003
    FCRA is the law governing the accuracy and privacy of credit reports. FACTA amended the Fair Credit Reporting Act in 2003 to strengthen and add to the protections for victims of identity theft. These laws require consumer reporting agencies (CRAs) and creditors to help victims recover from identity theft, and allow consumers to place alerts on their credit files if they are or believe they may become victims of identity theft (fraud alerts). Consumers have the right to dispute inaccurate information, and CRAs and creditors must investigate the claim and correct information if it is inaccurate. The laws also entitle consumers to a free credit report once per year from each of the three credit reporting agencies. As part of the responsibilities under FACTA, the Federal Trade Commission and the federal financial agencies established Red Flag Rules requiring creditors and financial institutions to establish programs designed to address identity theft.

    Identity Theft Penalty Enhancement Act of 2004
    This act (Pub. L. 108–275 § 1028A) establishes penalties for aggravated identity theft, which is using the identity of another person to commit felony crimes, including immigration violations, theft of another s Social Security benefits, and acts of domestic terrorism.

    Identity Theft Enforcement and Restitution Act of 2008
    This act amends 18 U.S.C. § 3663(b) to make it clear that restitution orders for identity theft cases may include an amount equal to the value of the victim s time spent remediating the actual or intended harm of the identity theft or aggravated identity theft. The new law also allows federal courts to prosecute when the criminal and the victim live in the same state. Under previous law, federal courts only had jurisdiction if the thief uses interstate communication to access the victim s PII.

    Driver s Privacy Protection Act of 1994
    The Driver s Privacy Protection Act puts limits on disclosures of personal information in records maintained by state departments of motor vehicles.

    Family Educational Rights and Privacy Act of 1974
    The Family Education Rights and Privacy Act puts limits on the disclosure of educational records maintained by agencies and institutions that receive federal funding.

    Gramm-Leach-Bliley Act of 1999
    The Gramm-Leach-Bliley Act (Pub. L. 106-102, 113 Stat. 1338) includes a Financial Privacy Rule, which requires financial institutions to provide consumers with a privacy notice when the consumer relationship is established and annually thereafter. The privacy notice must explain what information the institution collects about the consumer, where that information is shared, how it is used, and how that information is protected. The notice must also identify the consumer s right to opt out of the information being shared with unaffiliated parties and notify him or her if the privacy policy changes.

    Health Information Portability and Accountability Act of 1996
    The privacy rule regulates the security and confidentiality of patient information. The U.S. Department of Health and Human Services published a final Security Rule in February 2003, which sets national standards for protecting the confidentiality, integrity, and availability of electronic protected health information.

    Pace and IDOT partner to offer Bus on Shoulder on Edens (I-94)

    Pace and the Illinois Department of Transportation (IDOT) will again partner to improve commutes and reduce congestion in the Chicagoland area. We are pleased to announce a 2-year demonstration of bus-on-shoulder service on the 13-mile stretch of the Edens Expressway (I-94) from Foster Avenue to Lake Cook Road.

    Since Pace introduced shoulder riding on I-55 in late 2011, on time performance for routes on the corridor has improved dramatically, from about 65% to over 90%. Ridership has more than quadrupled in the corridor, proving that reliability plays a significant role in attracting and retaining riders. While ridership may not increase at those levels on the Edens, Pace does expect to see ridership growth and improved schedule reliability.

    Pace will kick-off bus on shoulders operations on the Edens with existing routes 620 (connects the CTA Dempster Station in Skokie and Allstate s Northbrook campus) and 626 (connects the CTA Dempster Station in Skokie and various commercial and business centers in Northbrook, Deerfield, Riverwoods, Buffalo Grove, and Lincolnshire).

    We ve seen unprecedented ridership growth along the I-55 corridor thanks to the bus on shoulder service, said Pace Chairman Richard Kwasneski. Since bus on shoulder operations began, ridership in the corridor has grown by almost five times. When there s congestion on the roadway, bus on shoulder service is faster and more reliable than driving. Commuters see that and choose our service over their cars. We believe they will do the same in the Lake-Cook region and are excited to partner with IDOT on this project.

    Additional routes that could utilize the I-94 service in the future are in the planning stages. Preliminary concepts aim to provide connections from the Jefferson Park Transit Center and the CTA Kimball Brown Line Station to the Lake Cook Corridor. Service expansion is based on the availability of funding and equipment and is subject to change.

    In coordination with IDOT and the Illinois State Police, safety focused operating rules similar to those in use on I-55 will be employed. Buses will use the outside shoulder lanes when general traffic slows to below 35 mph. While using the shoulders, the bus will not exceed the speed of regular traffic by more than 15 mph and the maximum speed for buses traveling on the shoulder is 35 mph. If the shoulder is unavailable due to an accident, law enforcement activity, or emergency response vehicles, Pace will merge back into the regular lanes.

    This minor modification to our infrastructure will have far-reaching benefits for commuters and the environment, said Illinois Transportation Secretary Randy Blankenhorn. Expanding the success of this convenient, innovative program to the Edens provides travelers in the region one more option to get to where they need to go, while reducing congestion and building more reliability into their trips.

    Construction has already begun on the Edens Expressway (Interstate 94) and includes resurfacing the outside shoulders and some travel lanes, adding new signage, and modifying rumble strips. Nightly lane closures will take place in both directions between Foster Avenue and Lake Cook Road. The expressway at times will be reduced to one lane in each direction during the overnight hours.     More than 350 schools in 43 states have implemented courses on the Bible for the 2009-2010 academic year, a new report reveals.

    Leading the pack is Texas where more than 50 schools are teaching the course this fall, according to data from the Bible Literacy Project, which publishes The Bible and Its Influence. a student textbook designed for public school courses on the Bible.

    Right behind Texas, schools in Georgia, California and Indiana are widely teaching lessons on the Bible using the Bible Literacy textbook. More than 10 percent of Georgia public high schools and more than 5 percent of public high schools in Alabama, Indiana and South Carolina are utilizing the program, said Chuck Stetson, chairman of the Bible Literacy Project board.

    The Bible and Its Influence – reviewed by 40 religious and legal scholars representing evangelical, mainline Protestant, Catholic, Orthodox and Jewish communities – is reportedly the first student textbook that fulfills the legal standards of The Bible Public Schools: A First Amendment Guide .

    It was released in September 2005 and the primary goal of the course is biblical literacy. While providing an academic study of biblical narratives and their influence on literature and culture, the course does not promote or discourage religious belief, the Bible Literacy Project insists.

    Their approach is academic and not devotional, and academic study of the Bible in public schools is legal in all 50 states, the organization says.

    Increasing knowledge about the Bible is part of a good education; but teaching what to believe belongs in the home,” the non-profit states. “We advocate providing a well-rounded, thorough education that includes the basic information students need to fully understand literature, as well as art, music, history and culture.”

    A 2004 Gallup poll found just 8 percent of public school teens said their schools offered an elective Bible course. But public-school courses on the Bible have been rising in popularity over the past several years.

    In 2007, the Texas legislature passed a law requiring public high schools to teach Bible literacy beginning in the 2009-2010 school year. The state law, however, did not provide any specific guidelines or teacher training and left many educators confused.

    Some Texas high schools are offering an elective course on the Bible this year while others have chosen to incorporate the lessons into current classes. Still others maintain that religious literature is already taught in their current courses.

    The Bible Literacy Project, meanwhile, has made online teacher training available. In partnership with Concordia University’s College of Education in Portland, Ore. the organization is sponsoring graduate-level courses on how to teach a legal, rigorous and academic public high school class on the Bible.

    The organization is currently seeking to reach educators in the remaining seven states – Delaware, Iowa, Montana, Nevada, Rhode Island, Utah, and Wyoming – that have yet to utilize The Bible and Its Influence .

    “We welcome the opportunity to show these remaining states the strength of our program,” said Stetson.

    Helping the homeless at the S.F. Public Library

    A medley of people wait for the San Francisco Public Library to open in the morning. Students on a deadline. People who really need a library book. Retired folks. And people checking email.

    As the doors open, patrons stream into the atrium at the main branch near the Civic Center in downtown San Francisco. Some head to their favorite reading nook; others to computers to start surfing the Web.

    The library is by nature a transitory place. Most people come and go. But Craig, who didn’t want his last name used, is usually here all day. Craig is homeless. Like thousands of other homeless people, he comes to the library when he has nowhere else to go.

    “It’s one of the few buildings that’s open 7 days a week, – and thank God for Tuesday, Wednesday, and Thursday, when it’s open until 8,” he says.

    Craig sits in a sunny room and reads the newspaper. He eats some bread and bananas. If he’s bored, he dozes off.

    “I come to the library basically because it’s quiet and it’s clean. It also doesn’t have the atmosphere that a lot of the drop-in centers have. A lot of the drop-in centers, you just feel like you’re homeless,” says Craig. “I’d never been homeless up until 3 months ago, so this is a new experience for me.”

    San Francisco’s public library system has become known for its digital innovations, special collections, and reading events. The Civic Center branch has also become known, for better or worse, as a homeless hangout. That has prompted a new kind of innovation.

    What started as a tough situation – staff members worried about people washing up in the bathrooms, or acting badly – turned into an opportunity. The library, which has always thought of itself as a resource, found it had nothing to offer people who came in asking for help finding housing or places to sleep. The city’s solution? Bring in a social worker assigned to deal with the needs of homeless people.

    That’s how, in 2009, Leah Esguerra became the first homelessness social worker in the country to be based out of a library.

    “What I’ve learned from being here is that the library’s goal is to include everybody, to make the library accessible for everybody, and not to screen anybody out,” she says, adding that the goal has been to help its homeless patrons and to make the library safer.

    “Having a library is a true part of democracy in our country, and democracy meaning you include everybody,” adds Esguerra.

    Since the program’s inception three years ago, Esguerra has reached out to nearly 1,200 homeless people at the library and referred them to city services. So far, 74 of them have also found housing.

    Esguerra doesn’t advertise her services. Instead, she relies on her outreach workers, also known as Health and Safety Associates. Kathleen, who didn’t want her last name used, is one of them.

    “I hang out in the library,” says Kathleen. “I check the bathrooms out, trying to get people to comply with library rules, like, don’t wash your hair in the bathroom sink and that kind of stuff. But the bigger picture is to give them options.”

    Just a few years ago, Kathleen was also homeless at the library. She used to be a house painter in Sacramento. Then the recession hit.

    “October 31, 2008 was the last day I worked and Lehman Brothers had just crashed and it was just like, the light switch… Someone flipped it off and there was no more work. It just stopped,” she recounts.

    Kathleen and her partner lost their house and started living in their car in San Francisco. When the car broke down, they spent rainy days drying off at the Mission Branch Library. Eventually some homeless outreach workers found them and helped them get back on their feet.

    “It was my time to accept help. So everybody in their lives will have that time, they will hold out their hand, and if we can just be there, that’s a hand up,” she says.

    According to the National Coalition for the Homeless. more than 3.5 million Americans may be homeless on a given night. Libraries across the country have become a destination for the poor and homeless to seek help with everything from finding a job to finding a place to sleep.

    “This question is always huge in urban libraries, around how much should a library take on of the homeless problem,” says Jill Bourne, San Francisco’s Deputy City Librarian. “Having the program is helping, but the bigger social issue is still looming and that’s kind of the bigger challenge.”

    Hundreds of city libraries across the country, including San Francisco, have tried to address that “bigger challenge” by opening job centers and adding resume workshops. The city’s social worker program has become a national model. Sacramento now has a homeless outreach worker on call at the Central Library. San Jose’s Martin Luther King Jr. Library brings social workers and lawyers in for free.

    But just as the role of the library has evolved to meet the needs of a population in peril, the group of people who need help has widened, too. Social worker Leah Esguerra says she sees students who have defaulted on their school loans and are living in their cars.

    “I’ve seen families displaced as well, the same situation. They lost their jobs, they lost their homes, they went through their savings and now, where do we go?” she says.

    This story originally aired in 2012. Since then, Jill Bourne has become the San Jose library director. Leah Esguerra is still in her same role in San Francisco.

    The 5 “Qs” of Public Service Loan Forgiveness

    #StudentLoanForgiveness. It’s a hashtag now, so you’ll all pay attention, right? Everyone wants their student loans forgiven. The perception is that very few qualify for any forgiveness programs. But did you know that there is one broad, employment-based forgiveness program for federal student loans? Most people don’t, or misunderstand how it works. Let me break down some key points of the Public Service Loan Forgiveness Program to help you figure out if you could qualify.

    Can you check the all the boxes?

    [ 1 ] Work in “Qualifying Employment”

    First, you need to work in “qualifying” employment; that is, you must work in “public service .” But what does that mean? Everyone seems to have a different definition. Ours is based on who employs you. not what you do for your employer. The following types of employers qualify:

    • Governmental organizations – Federal, state, local, Tribal
    • Not-for-profit organization that is tax-exempt under Section 501(c)(3) of the Internal Revenue Code
    • A not-for-profit organization that provides some specific public services, such as public education, law enforcement, public health, or legal services

    The following types of employers do not qualify:

    • Labor unions
    • Partisan political organizations
    • For-profit organizations

    [ 2 ] “Qualifying Employment Status”

    If you work at one of these types of organizations—great! That’s the most difficult criteria to meet. Next, you need to work there in a “qualifying” employment status, which means that you must be a full-time employee of the organization. Full time, for our purposes, generally means that you meet your employer’s definition of full time or work at least 30 hours per week, whichever is greater.

    [ 3 ] Have a “Qualifying Loan”

    A “qualifying” loan is a Direct Loan. It’s that simple. Of course, it’s the government, so nothing is actually that simple. You see, there are (or were) three big federal student loan programs:

    • The Direct Loan Program, which is now the biggest program,
    • The Federal Family Education Loan (FFEL) Program, which is what many students borrowed from until mid-2010, and
    • The Federal Perkins Loan Program. which is a relatively small program.

    You may have loans from just one of these programs, or you may have borrowed from all three. If you’re not sure which loan program you borrowed from, I can’t blame you—I had 20 separate loans by the time that I finished graduate school! You can use the National Student Loan Data System to determine which program you borrowed from. Here’s a tip from me to you: basically, if you see “Direct” in the loan type name, it’s a Direct Loan. Otherwise, it’s not.

    Don’t have a Direct Loan? Don’t despair! You can consolidate your other federal student loans into a Direct Consolidation Loan and qualify that way. Not having a Direct Loan is the biggest reason that borrowers who are seeking Public Service Loan Forgiveness aren’t on the right track, so be sure that all of your loans that you want forgiven are Direct Loans before you proceed to the next step. If you do need to consolidate, be sure to check the box in the application that says that you’re consolidating for the purposes of loan forgiveness. It will make your life easier, I promise.

    [ 4 ] Have a “Qualifying Repayment Plan”

    Next, you need a “qualifying” repayment plan. All of the “income-driven repayment plans ” are qualifying plans for Public Service Loan Forgiveness. So is the 10-year Standard Repayment Plan, but if you’re on that repayment plan, you should switch to an income-driven repayment plan straight away. or you will have a drastically lower loan balance left to be forgiven after you meet all of the criteria.

    If you’re consolidating your loans, you can apply for an income-driven repayment plan in the consolidation application. but if you don’t, you will be placed on the Standard Repayment Plan for Direct Consolidation Loans. which is almost never a qualifying repayment plan for Public Service Loan Forgiveness. If you already have Direct Loans, you can submit an income-driven repayment plan application on StudentLoans.gov .

    [ 5 ] Make 120 “Qualifying Payments”

    Lastly, you need to make “qualifying” payments—120 of them. A qualifying payment is exactly what you would expect it to be. You get a bill. It has an “amount due” and it has a “due date”. Make the payment in that amount by the due date (or up to 15 days after), and the payment is a “qualifying payment”. If you make a payment when you’re not required to—say, because, you’re in a deferment or you paid your student loan early—then that doesn’t count. But if you reliably make your payment every month for 10 years, you should be okay. The best way to ensure that your payments qualify is to sign up for automatic payments with your loan servicer .

    Note that these payments do not need to be consecutive. So, if you had made 10 qualifying payments, and then stop for a period of time (say, you go on a deferment), then start making qualifying payments again, you don’t start over; instead, you pick up where you left off.

    And, I’m sorry to have to mention a seemingly arbitrary date, but a payment only qualifies if it was made after October 1, 2007, so nobody can qualify for Public Service Loan Forgiveness until 2017 at the earliest.

    Ok, so do I qualify?

    Now that you have the details, let me explain how all of the criteria work together. For any payment to count toward Public Service Loan Forgiveness, you need to meet all of the criteria when you make each payment. Stated differently, you need to be working for a qualifying employer on a full-time basis when you make a qualifying payment under a qualifying repayment plan on a Direct Loan. When you break these criteria down separately, it seems simpler. It’s when you try to pack it into one sentence that it seems overwhelming.

    As much as I’d like to think that all of you now have a perfect understanding of this program and how it works, I know all of you are thinking—“okay, but do I qualify?” Here’s how you find out. Download this form. Fill it out. Have your employer certify it. Send it to FedLoan Servicing (one of our federal student loan servicers ), queue up How I Met Your Mother on Netflix, and wait for an answer. FedLoan Servicing will do the following:

    • Check whether you have any qualifying loans.
    • If you have qualifying loans, validate that your employment qualifies. If none of your loans qualify, they’ll tell you so.
    • If your employment qualifies, they will send you a letter confirming that your employment qualifies. Then, any of your federally held loans that are not serviced by FedLoan Servicing will be transferred to them so that we can keep better track of your loans and payments for Public Service Loan Forgiveness. If your employment doesn’t qualify, they’ll tell you so.
    • After your loans are transferred, they will match up the dates of employment on the form that you submitted to the payments you made during that time and determine how many qualifying payments you made. You’ll receive a letter with a count of qualifying payments and an anticipated forgiveness date (which assumes that all your future payments also qualify).

    It’s after you get this payment count back that you’ll know whether you’re on the right track. So, it really is a good idea to submit this form early and often. We recommend that you submit the form once per year or when you change jobs. The beauty of submitting these forms early and on an ongoing basis is that it means that you won’t have to submit 10 years’ worth of them when you ultimately want to apply for forgiveness. It also means that when you apply for forgiveness, that you’ll be able to do so with confidence that you qualify for it.

    One more piece of good news: Public Service Loan Forgiveness is not considered income by the IRS. That means that it’s tax-free.

    Student loans — public or private?

    (MoneyWatch) Need to borrow to finance college? You’ve got plenty of company. Roughly two-thirds of students do.

    However, it’s important to understand that there are two distinct student loan types: Federal loans. offered through the U.S. government, have dozens of protections that you don’t get with private loans. Private loans are offered through lenders, such as banks, credit unions, and companies, such as Sallie Mae, as well as through schools. And, while private loans can still seem like a bargain because of their low “teaser” rates, they often cost thousands of dollars more over the life of the loan and leave borrowers with few options when it comes time to repay.

    How do the loans compare?

    Interest rates

    Federal loans

    The interest rate is fixed and is the same for every borrower.

    Private loans

    The interest rate “floats” based on an index rate, plus a “margin.” So, for instance, if the rate was based on prime, plus 9 percentage points, it would currently be 3.25 (prime) plus 9 for a total rate of 12.25 percent. The margin, however, will vary from borrower to borrower based on the credit history of the borrower and, where applicable, the co-signer.

    Interest build-up

    Federal loans

    Students generally do not need to make payments on student debt while they are in school, are unemployed or in the 6-month “grace period” following graduation. With “subsidized” federal loans – the type given to students who are deemed to have sufficient financial need — the government pays whatever interest accrues during those periods. That means the borrower’s loan balance does not rise while they are in school.

    “Unsubsidized” federal loans accrue interest at a set fixed rate while the student is in school and the loan is in deferment. Thus, the loan balance at graduation is likely to be higher than it was originally. It is fairly simple for borrowers to know how much they will owe, by using a web calculator such as BankRate.com’s Simple Savings calculator. If you were borrowing $5,000 at 6.8%, and figured the loan would be outstanding for four years while you were in school, for instance, you’d plug those numbers into the form and find that you’d owe $6,558 at graduation.

    Private loans

    Like unsubsidized federal loans, interest accrues on private loans from the day they are funded. However, because the interest rate is variable, it’s impossible to know exactly how much you’ll owe at graduation. To avoid graduation loan-shock, some lenders encourage or require borrowers to pay at least the amount of interest accruing while they are still in school.

    Borrower protections

    Federal loans

    All federal student loans come with terms that protect the borrower from economic devastation if they lose their job, go back to school or have some other economic hardship. For instance, repayment of federal student loans can be “deferred” or placed on hold for up to three years, if you lose your job, join the Peace Corps or are called to military service. Repayment of federal loans is also deferred when you go back to school. During periods of deferment, interest will accrue on unsubsidized federal loans, but not subsidized federal loans.

    In addition, if you don’t qualify for deferment, federal loans have additional check, called “forbearance,” which can place repayment on hiatus because you are ill, or meet other requirements. Here’s a handy guide to see if you qualify for student loan forbearance.

    Private loans

    Private loans don’t necessarily allow borrowers to put their payments on hiatus for any reason. If you have a hardship, you can appeal to the lender for a deferment or forbearance. But whatever your reason, the lender may not agree. And if it does, it may levy a fee (in addition to accruing interest) to provide the deferment.

    Repayment options

    Federal loans

    Federal loans now offer seven different repayment options, including “standard” repayment, which pays off the debt in 10 years, and extremely flexible “pay as you earn” plans, that allow you to base your payments on how much you earn. (See “New and improved ways to pay student loans”).

    Private loans

    Typically provide two repayment options – standard and extended. You generally do not have the right to vary your payment based on your income. If you don’t earn enough to repay the loan, you are likely to accrue additional penalties and interest.

    Discharge of debt

    Federal loans

    If you are disabled or go into public service or teach in some low-income areas, all or a portion of your federal loans can be forgiven or discharged – wiped away. The Department of Education has a long chart on the discharge options here.

    However, federal student loans are generally not dischargeable in bankruptcy.

    Private loans

    Private student loans are generally not dischargeable in bankruptcy and the federal programs that allow you to discharge the debt when you go into public service or social work do not apply to private student debt.
